I appreciate your ability to help us develop safe and
reasonable solution to our compliance issues.
RETURN TO COMPLIANCE
(See attached Return to Compliance Certification form)
Regarding your inspection report of October 21, 2013
1. #125 Failed to keep a copy of consolidated manifests for 3 years.
a. As I discussed with you back on December 3, 2013, 1 made multiple
requests to Evergreen Environmental to supply the two missing manifests
for 06/06/11 and 10/25/2012.
b. Due to the sale of Evergreen Environmental to Safety-Kleen Systems,
they were unable to comply with my requests but they were only able to
provide me with a customer -history report as they claimed they did not
have access to archived files.
a. The above mentioned customer -history report shows the amount of oil that
was picked up on those two dates. A copy of that report is attached as
item 1.
2. #305 Failed to maintain all communication or alarm systems, spill control, or
decontamination equipment.
a. After repeated calls to Evergreen Environmental to empty the used oil
tanks and empty/clean the secondary containment area, the tanks were
finally serviced on November 20, 2013. Staff cleaned and dried the tanks
and containment vessels before placing them back in service.
b. Staff has implemented new procedures and will inspect those tanks and
the secondary containment vessels on a weekly basis and service/clean
as necessary. Every 6 months, or each time the tanks are emptied, staff
will clean and dry the tanks before placing the tanks back in service.
Triangle"Think Inside the
