Miner, Stockton <br />Program: HW <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR -Notice to Comply) <br />606. (This violation was previously identified in the June 20, 2011 routine hazardous waste inspection) <br />18 spent lead -acid batteries under pedestrian ram the owner stated were waste last year, and 31 spent <br />lead -acid batteries inside the shop which the owner had stated he was going to recharge and sell last <br />year, have been stored on site more than 1 year. A facility that generates less than one ton of spent <br />lead -acid batteries may store the spent lead -acid batteries on site for a maximum of 1 year. Immediately <br />dispose the spent lead acid batteries in accordance to Title 22, submit a copy of the disposal receipt to <br />EHD by July 1, 2012, and retain all disposal records on site for at least three years. <br />NOTES (The following are not violations) <br />The facility generated less than 5 tons of hazardous waste in 2011 based on interview with owner. The <br />precious weight is unknown since generator did not keep disposal receipts nor disposed of the <br />hazardous wastes identified in 2011. Facility is a used car business and generates hazardous waste <br />from repairing vehicles for resale. <br />108. Owner stated that the liquid in the metal bath identified in the June 22, 2011 inspection was used <br />oil and he had placed it in the red metal drum. Owner stated he was able to place to oil in the drum <br />which was observed nearly full in 2011 since he had taken some of the oil from the drum to Pep Boys. <br />Please be aware that generator of hazardous waste is required to make hazardous waste determination <br />of the waste and manage the waste accordingly. <br />804. Owner stated and demonstrated the four universal waste fluorescent lamps identified in the June <br />22, 2011 inspection were not waste and placed back into the light fixture, although 3 of the lamps in the <br />light fixture do not appear to work. Please be aware that universal wastes, including aerosol cans, <br />lamps, alkaline batteries, mercury containing switches, CRT, electronic devices, etc. shall be stored in a <br />closed container that prevents breakage and release to the environment, labeled to identify the type of <br />Universal Waste and the initial date of accumulation, and can be stored on site up to one year <br />A copy of Auto Repair Management Practice factsheet, CUPA class schedule, blank hazardous waste <br />labels, hazardous waste labeling factsheet, and San Joaquin County Small Business Hazardous Waste <br />Disposal Program pamphlet, have been provided to generator during this inspection. <br />Submit the following to EHD by: July 1, 2012 <br />1) A completed copy of the (provided) Return to Compliance Certification <br />2) A written statement how each violation was corrected <br />3) Evidence (i.e. photos, disposal receipts, documents) in support of the corrections made. <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br />THIS FACILITY IS SUBJECT TO REINSPECTI N AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br />EHD Inspector: <br />Re ived By: <br />Title: <br />Jeffrey Wong (209) 468-0335 <br />/ toll <br />EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
