Notice to Comply/ Minor Violations: 7,20, 23, 30, 83, 83 <br /> 7. Several old rusty paint cans located on the wooden shelf outdoors adjacent to the mechanic shop <br /> have been determine to be a waste per Luis. Any person who generates a waste shall determine if the <br /> waste is a hazardous waste. Correct by making a determination if the contents are a hazardous waste <br /> according to California Code of Regulations, Title 22, HW Regulations OR properly dispose the paint <br /> cans as hazardous waste. Submit a statement and supporting documentation explaining how this waste <br /> will be managed by 10/29/10. <br /> 20. A used oil tank of approximately 250 gallons located in the mechanic shop lack an initial start <br /> accumulation date. All hazardous waste tanks shall be marked with the words "Hazardous Waste" and <br /> the accumulation start date. Immediately ensure that all hazardous waste tanks are marked with the <br /> required information. <br /> 23. Two 55 gallon drums of used oil filters both lack an accumulation start date. Used oil filters must be <br /> stored in a closed, rainproof container, labeled as "drained used oil filters," and marked with an <br /> accumulation start date. Immediately document the initial start accumulation date on both drums and <br /> ensure that all used oil filters are managed in this way. <br /> 30. Approximately ten empty 55 gallon drums are scattered behind the mechanic shed, in the weeds in <br /> front of the mechanic shed. It is unknown how long they have been unsite. Containers larger than five <br /> gallons that previously held a hazardous material shall be marked with the date they were emptied and <br /> managed within one year of being emptied. Immediately mark and manage all empty containers per this <br /> section. Correct by submitting a disposal receipt for the drums by 10/29/10. <br /> 83 & 84. An old broken electric standing fan located in the breakroom and two unused microwaves <br /> located nearby the storage area for nails are not identified as waste. It is unknown how long they have <br /> been stored onsite. Universal Waste (UW) must be labeled as "Universal Waste-electronic device" and <br /> must be managed within 1 year. Correct by ensuring all universal waste are marked with the required <br /> information and submit a disposal receipt to SJC EHD within 30 days. <br /> Submit to SJC EHD within 30 days (10/29/10): 1. one copy "Return to Compliance Certification" form, 2. <br /> a written corrective action statement & 3. disposal receipts <br /> Notes: - UW fluorescent tubes in mechanic shed still in ballast CANNOT be thrown in garbage.
