Doug baker also alluded to the waste being on site longer than 90 days by stating that "the waste had been accumulating since at least last year"♦. This facility does not have documentation authorizing it as a storage facility. ♦ Statement from interview on May 13, 2003;meaning the waste had been accumulating for at least 163 days. 4. CCR,Title 22,section 66265.173(a) Failed to keep hazardous waste containers closed. A container holding hazardous waste shall always be closed during transfer and storage, except when it is necessary to add or remove the waste —>Delta Plating failed to keep containers closed; (i.e.)"buckets, 55 gallon drums, hazardous waste tank, and filter cake containment tank". 5. CCR,Title 22, Section 66262.34(f) Failed to properly label containers of hazardous waste (1)the date upon which each period of accumulation begins shall be clearly marked and visible for inspection on each container and portable tank. (3)Each container and tank used for onsite accumulation of hazardous waste shall be labeled or marked clearly with the words, "Hazardous Waste."Additionally, all containers and portable tanks shall be labeled with the following information: (A) composition and physical state of the waste; (B) statement or statements that call attention to the particular hazardous properties of the waste (e.g., flammable,reactive, etc); (C)name and address of the person producing the waste. - >Delta Plating failed to properly label many of the 55-gallon drums containing hazardous waste,Delta plating also failed to properly label a waste oil container, several super sacs, and a very large tank of hazardous waste. 6. CCR,Title 22,section 67450.2 (b) Failed to complete& submit proper notification forms. The owner or operator of a FTU that treats hazardous waste shall be deemed to have a permit when the owner or operator complies with subsections (b)(1), if applicable, (b)(2), (b)(3), and(b)(5) of this section, and receives acknowledgement from CLPA or authorized agency authorizing operation of the FTU pursuant to subsection(b)(4) of this section. —>Delta Plating failed to submit properly complete documents. In 1995 Delta Plating submitted a notification form to be a conditionally exempt small quantity generator. The 1995 document stated that the facilities only treatment processes included the use of a filter press. A completed DTSC 1772 form is required specifically for each tier of treatment prior to treatment. A completed DTSC 1772 form is needed for the combination treatment of chromium VI to chromium III. This facility also illegally treated cyanide since it was treating cyanide without the needed DTSC cyanide order. The proper documents had not been completed prior to the May 06,2003 inspection. The DTSC is currently reviewing the possibility of a cyanide order for Delta Plating Inc.
