Doug baker also alluded to the waste <br /> being on site longer than 90 days by stating that "the waste had been accumulating since <br /> at least last year"♦. This facility does not have documentation authorizing it as a storage <br /> facility. <br /> ♦ Statement from interview on May 13, 2003;meaning the waste had been accumulating <br /> for at least 163 days. <br /> 4. CCR,Title 22,section 66265.173(a) Failed to keep hazardous waste containers <br /> closed. <br /> A container holding hazardous waste shall always be closed during transfer and storage, <br /> except when it is necessary to add or remove the waste <br /> —>Delta Plating failed to keep containers closed; (i.e.)"buckets, 55 gallon drums, <br /> hazardous waste tank, and filter cake containment tank". <br /> 5. CCR,Title 22, Section 66262.34(f) Failed to properly label containers of <br /> hazardous waste (1)the date upon which each period of accumulation begins shall be <br /> clearly marked and visible for inspection on each container and portable tank. <br /> (3)Each container and tank used for onsite accumulation of hazardous waste shall be <br /> labeled or marked clearly with the words, "Hazardous Waste."Additionally, all <br /> containers and portable tanks shall be labeled with the following information: (A) <br /> composition and physical state of the waste; (B) statement or statements that call <br /> attention to the particular hazardous properties of the waste <br /> (e.g., flammable,reactive, etc); (C)name and address of the person producing the waste. <br /> - >Delta Plating failed to properly label many of the 55-gallon drums containing <br /> hazardous waste,Delta plating also failed to properly label a waste oil container, several <br /> super sacs, and a very large tank of hazardous waste. <br /> 6. CCR,Title 22,section 67450.2 (b) Failed to complete& submit proper <br /> notification forms. <br /> The owner or operator of a FTU that treats hazardous waste shall be deemed to have a <br /> permit when the owner or operator complies with subsections (b)(1), if applicable, (b)(2), <br /> (b)(3), and(b)(5) of this section, and receives acknowledgement from CLPA or <br /> authorized agency authorizing operation of the FTU pursuant to subsection(b)(4) of this <br /> section. <br /> —>Delta Plating failed to submit properly complete documents. In 1995 Delta Plating <br /> submitted a notification form to be a conditionally exempt small quantity generator. The <br /> 1995 document stated that the facilities only treatment processes included the use of a <br /> filter press. A completed DTSC 1772 form is required specifically for each tier of <br /> treatment prior to treatment. A completed DTSC 1772 form is needed for the <br /> combination treatment of chromium VI to chromium III. This facility also illegally <br /> treated cyanide since it was treating cyanide without the needed DTSC cyanide order. <br /> The proper documents had not been completed prior to the May 06,2003 inspection. <br /> The DTSC is currently reviewing the possibility of a cyanide order for Delta Plating Inc. <br />
