1.6. The terms used in this Consent Agreement are as <br />defined in Section 66260.10 of Title 22 of the California <br />Code of Regulations (Cal. Code Regs.), except as otherwise <br />provided. <br />1.7. Respondent agrees to implement all approved <br />workplans and to undertake all actions required by the <br />terms and conditions of this Consent Agreement. <br />1.8. Respondent waives any right to request a hearing <br />on this Consent Agreement pursuant to HSC section 25187. <br />FINDINGS OF FACT <br />2.1. On May 18, 2004 Respondent submitted a Phase I <br />Environmental Assessment pursuant to HSC section 25200.14 <br />Phase I). The Phase I identifies three areas of concern <br />main plating room, wastewater treatment area, and storm <br />drain outside of the plating room). <br />2.2. Based on review of the Phase I Environmental Site <br />Assessment report dated May 18, 2004, and site inspection <br />conducted on May 20, 2004, DTSC concludes that further <br />investigation is needed to determine. the nature and extent <br />of contamination at the Main Plating room (AOC#1), and the <br />Wastewater treatment area (AOC#2). <br />2.3. The hazardous waste and hazardous waste <br />constituents of concern at the Facility are Acids/Base with <br />PH ranges < 2.0 & > 12.5, metals and Cyanide. <br />2.4. The hazardous wastes or hazardous waste <br />constituents have migrated or may migrate from the Facility <br />into the environment through the following pathways: soil, <br />groundwater and surface water run-off. <br />2.5. The Facility is located in an area of moderate <br />industrial and commercial development with scattered <br />residential homes. <br />PROJECT COORDINATOR <br />3. Within fourteen (14) days of the effective date of <br />this Consent Agreement, DISC and Respondent shall each <br />designate a Project Coordinator and shall notify each other <br />in writing of the Project Coordinator selected.
