Acacia Street, Stockton <br /> NOTICE TO ABATE IMMEDIATELY(Revised from October 7, 2011 version) <br /> The San Joaquin County Environmental Health Department(EHD)has reviewed the <br /> letter dated September 8, 2011 from Christopher Arismendi, CEO/President of the Board <br /> of Directors, requesting the existing diesel underground storage tank(the tank)to remain <br /> in service until the electrical interconnection work at the hospital is complete. <br /> The Environmental Health Department(EHD) was informed the tank had been taken out <br /> of service and the fuel removed in June 2011. The tank had been regulated as an <br /> emergency generator system under California Code of Regulations CCR 2636(0(6). <br /> Based on the above letter the tank is no longer be regulated a part of an emergency <br /> generator system,but shall be regulated as an underground storage tank under Title 23 <br /> CCR 2636. The tank is currently is not being monitored and therefore out of regulatory <br /> compliance under Health and Safety Code Section 25291(a) and(b), and CCR 2636(f)(1), <br /> (2), (4), and(5)(A) and (B). <br /> Violation: <br /> California Health and Safety Code, Section 25291. Every underground storage tank <br /> installed after January 1, 1984, shall meet all of the following requirements: <br /> (a) The underground tank shall be designed and constructed to provide primary <br /> and secondary levels of containment of the hazardous substances stored in <br /> it. <br /> (b) The underground tank system shall be designed and constructed with a <br /> monitoring system capable of detecting the entry of the hazardous substance <br /> stored in the primary containment into the secondary containment. <br /> i <br />
