• 0 <br /> PUBLIC HEALTH SERVICES <br /> SAN JOAQUUN COUN-1-Ir <br /> E\+VLR0Nt QyfEN i A.I-H .KITH DIVISION <br /> NLRH , %eu.ith 0=1 =r <br /> 304 St Wcbc_ave.�uc, iird:ioor• Scocroa <br /> Zi , C 95202 <br /> 209/463-3420 <br /> November 9, 1998 <br /> RE: <br /> Dear Underground Storage Tank Owner/Operator: <br /> According to Environmental Health Division (EHD) records, it appears your underground storage tank system will <br /> not meet the December 22, 1998 underground storage tank upgrade deadline. if this is the case, your facility will <br /> not receive a compliance sticker or tags enabling you to receive fuel after January 1, 1999. <br /> Assembly Bill 1491, signed by the Governor in 1997, bans fuel delivery to underground storage tank systems that <br /> are not upgraded. Single-walled motor vehicle fuel (MVF) tanks and piping, as well as doubie-walled tanks without <br /> striker plates. cathodic protection and spill and overfill protection, all must be upgraded. In some cases, a site <br /> assessment under permit from this office will be required to confirm that no leakage has occurred in the upgraded <br /> system, before you will be eligible to receive your compliance sticker and tags. <br /> For the past four years, the EHD has mailed information to all underground storage tank facilities concerning the <br /> 1998 upgrade requirements. All facilities were also mailed a listing of State Water Resources Control Board <br /> (SWRCB) workshops in July of 1997 which provided more information on upgrade requirements. Additionally, the <br /> EHD invited all San Joaquin County owners/operators of regulated underground storage tanks to attend the <br /> EHD/SWRCB special upgrade workshops held at San Joaquin Delta College in December of 1997. <br /> All owners/operators of MVF underground storage tank systems and non-motor vehicle fuel (waste oil, chemical, <br /> etc.) single-walled tank systems not scheduled for an upgrade under an EHD permit by December 22, 1998, are <br /> required to submit an acceptable closure permit to the EHD by December 22, 1998, with the tank system removal <br /> occurring within 90 days of permit approval. In addition to submittal of the closure plan, the tank(s) must be drained <br /> of product/waste and rendered non-hazardous by December 22, 1998. To achieve this, the tank(s) must be <br /> "certified" clean by a person authorized on the Cal-EPA Department of Toxic Substances Control "Tank Closure <br /> Certification Form" (Form # DTSC 1249). You must also check with the local fire agency to assure you are in <br /> compliance with their laws and regulations prior to permanent removal of any product or waste. <br /> If this deadline is not met, legal action may be necessary for underground storage tank systems that are out of <br /> compliance. Your eligibility for the State Cleanup Fund may also be jeopardized if the tank system is not brought <br /> into compliance. <br /> Please call your area inspector as soon as possible to review the requirements for your site.
