The facility has been locked and business closed; therefore the underground storage tank(UST) system is not being monitored that will prevent unauthorized releases. UST system shall be operated to prevent unauthorized releases. Immediately arrange to provide continuous monitoring of the UST system, or submit to EHD a completed UST removal permit application if the UST will no longer be operated, or a temporary UST closure permit application if the UST system is to return to operation within one year of cessation. This is a Class II violation. 2030 The referenced business was verified closed with no one present to facilitate continuous monitoring of the UST system; therefore the UST system is considered illegally abandoned. According to California Health and Safety Code(HSC) Section 25298(a), no person shall abandon an UST system. Immediately submit a completed permit application to have the USTs removed along with appropriate fee to EHD; a temporary tank closure permit may be submitted in lieu of tank removal if the UST system is to return to operation (and monitored)within one year of end of operation.
