1 violation of California Code of Regulations, title 23 section 2638(a); <br />2 f. Failed to submit a completed Monitoring System Certification form to the local <br />3 agency, in violation of California Code of Regulations, title 23 section 2638(d); <br />4 g. Failed to record or report any unauthorized release from the underground storage <br />5 tank, and any spill or overfill, in violation of California Code of Regulations, title 23 section 2650(b); <br />6 h. Failed to maintain written monitoring and maintenance records on-site, in violation <br />7 of California Code of Regulations, title 23 section 2712(b); <br />8 I. Failed to identify and submit a signed statement to the local agency indicating the <br />9 designated underground storage tank operator for each facility, in violation of California Code of <br />10 Regulations, title 23 section 2715(x); <br />11 1 j. Failed to maintain a copy of the monthly inspection record and all attachments for <br />12 the previous twelve months, in violation of California Code of Regulations, title 23 section 2715(e). <br />13i 5. Defendants, in the course of Defendants' GASOLINE SALES/MM-MART activities, are <br />14 pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />15 a. Violation of Health and Safety Code section 25100 et seq. described in <br />16 paragraph 3 - 3e above. <br />17 b. Violation of Health and Safety Code section 25280 et seq. described in paragraph 4 <br />18 - 4j above. <br />19 6. Defendants shall pay to Plaintiff the sum of SIX THOUSAND DOLLARS ($6,000.00), as <br />20 and for civil penalties, pursuant to Health and Safety Code §25299. Said payment shall be made <br />21 a le to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT - <br />22 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br />23 Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, on or before <br />24 APRIL 1, 2010. <br />25 7. Defendants shall pay to Plaintiff the sum of SIX THOUSAND DOLLARS ($6,000.00), as <br />26 and for civil penalties, pursuant to Business and Professions Code section 17206.
