Matar TELEPHONE: (408) 624-7667 <br />TYPE OF PROGRAM KECORD <br />❑ COMPLAINT ❑ROUTINE ❑CONSULTATION MOTHER 2361 PR0231092 <br />INSPECTION: I ELEMENT: ID#: <br />NATURE OF COMPLAINTIVIOLATION: <br />The underground storage tanks (USTs) at this facility are not under continuous monitoring and have <br />been out of compliance since June 2011 due to a fire. According to Mr. Matar, the fuel has been <br />removed from the tanks, the power to the building is intermittent, and the monitoring panel is not <br />being checked daily. The site is currently unmanned. The UST system is in violation of California <br />Code of Regulations, Title 23 (23 CCR) and California Health and Safety Code, Chapter 6.7 (CA <br />VIOLATIONS/OBSERVATIONS: <br />CA H&SC 25291(b): The UST monitoring system shall be capable of detecting a leak from the <br />primary containment into the secondary containment at all times. <br />23 CCR 2636(f): All monitoring equipment shall be maintained to activate an audible and visual <br />alarm or stop the flow of product at the dispenser when it detects a leak. <br />23 CCR 2670(e): The time period between cessation of hazardous substance storage and <br />application for temporary or permanent tank closure shall not exceed 90 calendar days. <br />CORRECTIVE ACTIONS/ORDER: <br />Immediately apply for and obtain a permit for temporary closure of the USTs at this site from the San <br />Joaquin County Environmental Health Department (EHD) or remove the USTs under a tank removal <br />permit from EHD. <br />Immediately take all necessary corrective actions to ensure that all three USTs at this facility are <br />under continuous monitoring until the temporary closure or tank removal has been finaled by the <br />CORRECT BY: Immediately <br />FAILURE TO COMPLY WITH THIS NOTICE <br />MAY RESULT IN FORMAL ENFORCEMENT ACTION <br />DONNA HERAN, REHS <br />DIRECTOR <br />INSPECTED BY:94'2PRINT NAME: <br />SIGNATURE OF= E101RONMENTAL HEALTH P <br />n <br />RECEIVED BY: <br />OF <br />DATE: <br />EHD 48-042 Rev. 08/10/10 NOTICE TO ABATE <br />
