MW -22-1996 <br />12:05 <br />OTOCKTON PERMIT CENTER <br />14 209+937+9893 P.03 <br />SAN <br />JOAQUIN <br />COUNTY HAZARDOUS MATERIALS - <br />INFORMATION GUIDE <br />The following are guidelines to identify businesses and to help building permit applicants determine whether they need to <br />comply with the hazardous materials reporting requirements of Chapter 6.95 of the California Health and Safety Code with the <br />Administering Agency. In San Joaquiti County, the Office of F:mergencv Services (OES) has been appointed to be the Local <br />Administering Agency. The program will provide County and other emergency response agencies with data needed for quick and <br />safe response to hazardous material incidents and community :fight -[o -know. <br />This form becomes an official disclosure which will he kept on file by OES for future reference. Should you have any <br />questions. please call our office at (209) 468-3469, <br />"Hazardous Material" means any material that, hec fuse of its quantity, concentration, or physical or chemical <br />characteristics. poses a significant present or potential heeard to human health and safety or to the environment if released into <br />the work place or the environment. (Includes fuels, petroleum products, paints, propane, oxygen, ammonia (AHM), chlorine <br />(AHMi, pesticides, fertilizers. and ha7.ardous waste:.. <br />GUIDELINES <br />Quest1Qa _1. <br />if you answered -No", the business is exempted from completing the Hazardous Materials Management Plan ;HMMP). If at a <br />later date the applicant determines that their business or a tenant will be handling hazardous materials, the applicant must inform <br />OLS within O days. <br />}uestigns l and 1 <br />If you answered "Yes". the business or future occupant must meet requirements of Chapter 6.95 Section 25505 of the California <br />Health and Safety Code prior to issuance of a certificate of occupancy. Businesses which handle hazardous materials, at the <br />California Threshold Planning Quantities, are required to file a HM_ IP. Please contact our office for further information, <br />1I you answered "Yes" to Question 2 but your situation applies to one of the following cxemptron: please, mark the appropriate <br />boxes on the survey form. <br />A.etailil Exemption - Products packaged for direct dist6hution to the general public are exempt from the program. <br />However, written findings may be used to eliminate the exemption for the following reasons: 1) Quantity creates an <br />unacceptable public hazard. 2) Product is being used directly by the business as partof its operations in addition to <br />being sold to the general public, and 3) general public docs not have ready ai:.cess to the product as it is stored by the <br />lousiness, i.e., large quantities in a warehouse. <br />B. Medical Exemption - Medical oil -ices which use my oxygen ar:dlor nitrous oxidc in quantities less. than 1,100 cubic <br />feet. <br />C. 1=IIr1il.Lxemption - Operation of a farm for the exclusive purpose of cultivating the soil. The definition of farm in the <br />law is not be construed to include businesses providing commercial pest control services, fertilizer application services, <br />product processing services, or packing shed services. Firms qualifying for the exemption are still required to submit <br />an annual chemical inventory and fee to the County Agricultural Commissioners Department. Please contact the <br />County Agricultural Commissioner's Department for further information, Businesses operating a commercial business <br />that meets the program requirements in additiiffl t0 ot5erating a "farni" as defined must comply with the HMMP <br />program for those materials associated with the conlmerciai business. <br />Questions and 4: <br />If you answered "Yes", the owner or future occupant handling an Acutely Hazardous Material must meet the requirements of <br />Chapter 6.95, Sections 25533 and 25534 prior to the issuance of a CCYLitica[c of occupancy.
