I provisions of this Final Judgment will be of no further force or effect sixty(60)days thereafter, <br /> 2 unless the People file a motion contesting the expiration of any injunctive provisions within forty <br /> 3 (40)days of receipt of the Notice of Termination. In the event that such motion is filed,none of the <br /> 4 injunctive provisions of the Final Judgment contested in the People's motion will terminate pending <br /> 5 the Court's ruling on the motion. The People reserve the right to contest termination exclusively on <br /> 6 the grounds that Defendant has not substantially complied in all material respects with the injunctive <br /> 7 provisions of paragraph 6 of the Final Judgment and to offer any evidence relevant to such motion. <br /> 8 Defendant reserves its rights to respond to any ground raised in the People's motion and to offer any <br /> 9 evidence relevant to such motion. The injunctive provisions in the Final Judgment will expire and be <br /> 10 of no further force or effect unless the Court(upon consideration of the Parties' pleadings and <br /> 11 arguments, if any)determines that the expiration of the provision at issue would not be in the interest <br /> 12 of justice,because Defendant has not substantially complied in material respects with the provision <br /> 13 of paragraph 6 of the Final Judgment. The termination of the injunctive provisions of the Final <br /> 14 Judgment shall have no effect on Defendant's obligation to comply with the requirements imposed <br /> 15 by statute,regulation,ordinance,or law. <br /> 16 10. Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND THREE <br /> 17 HUNDRED THIRTY-SEVEN DOLLARS AND FIFTY CENTS($1,337.50)as partial recovery of <br /> 18 the cost of investigation and suit incurred by the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 19 HEALTH DEPARTMENT. Said payment shall be due and p4yable to the aforementioned agency, <br /> 20 and shall be delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 21 Prosecutions Unit,at time of signing. <br /> 22 11. Defendant shall additionally pay to Plaintiff the sum of THREE THOUSAND TWO <br /> 23 HUNDRED DOLLARS($3,200.00)as partial recovery of the cost of investigation and suit incurred <br /> 24 by the San Joaquin County Office of the District Attorney. Said payment shall be due and payable to <br /> 25 the aforementioned agency,and shall be delivered to the San Joaquin County Office of the District <br /> 26 Attorney,Environmental Prosecutions Unit,at time of signing. <br /> 27 12. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br /> 28 1 proceeding in the Superior Court.
