1 injunction, only insofar as they are doing business in the State <br />2 of California and confined to defendants' construction <br />3 activities in the County of San Joaquin and elsewhere in the <br />4 State of California. <br />5 3. Defendants, in the course of defendants' construction <br />6 business, are pursuant to Business and Professions Code S 17204 <br />7 and. Health and Safety Code §5 25184 and 25299.01 hereby <br />8 permanently enjoined from: <br />9 a) Violation of laws and regulations regarding treatment <br />10 and disposal of hazardous waste; <br />11 b) Violation of laws and regulations regarding underground <br />12 storage tank closure and removal.. <br />13 4. Defendants shall pay to plaintiff the sum of FIFTY <br />14 THOUSAND DOLLARS ($50,000.00), as and for civil penalties, <br />15 pursuant to Business & Professions Code S 17206. Said payment <br />16 shall be due and payable to the Treasurer of San Joaquin County <br />17 and delivered to the Office of the San Joaquin County District <br />18 Attorney, Environmental Prosecutions Unit, as follows: <br />19 a) $5,000 prior to entry of judgment; <br />20 b) Seven (7) payments due each year on the anniversary <br />21 date of the entry of judgment in the amount of $6,428.57; for a <br />22 total of $45,000. <br />23 C) Defendant shall have a one year extension on payments <br />24 for any year in which his.previous years defendant Frahm's <br />25 previous year's gross individual income falls below $50,000; <br />26 d) 90 days after any payment required herein becomes <br />27 delinquent, the entire remaining civil penalties shall become <br />28 due and owing; <br />2 <br />
