UST owners are included in this new requirement. A copy of the SWRBC flyer entitled "ACT NOW', explaining the responsibilities of UST owners and the deadlines by which you must comply, is enclosed with this letter. This second notification is being sent through certified mail so you understand the importance of the January 1, 2005, deadline to submit the owner's compliance statement (described below) and identify the ICC certified Designated UST Operator(s)* for all of your underground storage tank (UST) facilities located within San Joaquin County. The owner's compliance statement mentioned above is required pursuant to California Code of Regulations, Title 23, section 2715 (a) which reads: By January 1, 2005, owners of underground storage tank systems shall submit a signed statement to the local agency indicating that the owner understands and is in compliance with all applicable underground storage tank requirements, and identifying the designated UST operator(s) for each facility owned. The owner shall inform the local agency of any change of designated UST operator(s) no later than 30 days after the change. To help you comply with these requirements, the San Joaquin County Environmental Health Department (EHD) is enclosing a document entitled "Owner Statements of Designated Underground Storage Tank (UST) Operator and Understanding of and Compliance with UST Requirements". To satisfy the requirements, the form must be complete and submitted to EHD's address on this letterhead before the January 1, 2005, deadline.
