The technician placed a new fill cap on the diesel <br />fill pipe and retested for the secondary time, but the technician quickly failed the test minute within 5 minutes. The <br />technician adjusted the original fill cap and diesel fill adapter and retested. All USTs shall be equipped with a spill <br />container that has a minimum capacity of five gallons and a drain valve that allows drainage of the collected spill into <br />the primary container or provide a means to keep the container empty. Immediately contact a properly licensed, <br />trained, and certified contractor to install an approved spill container under permit and inspection of the EHD. If a <br />spill container can't be installed immediately, there is a possibility that the diesel UST system may be red tagged to <br />prevent fuel inputs. After the adjustments, the technician verified that the diesel fill container passed and I witnessed <br />the spill container testing. <br />This was corrected on site. <br />This is a repeat violation, Class II. <br />324 <br />CCR 2717.1(g) Tampered with red tag. <br />On March 22, 2018, per conversation with Pete Chahoud, he stated that he had tested the diesel spill bucket on <br />3/21/2018, by removing the red tag bag in order to get the cap. I observed the Nylon Tamper Resistant Strap <br />missing and the Red Tag Bag on top of the diesel fill pipe. I placed a Red Tag Bag and Nylon Tamper Resistant <br />Strap on the diesel fill pipe on March 14, 2018. The inventory level in the diesel tank on March 14, 2018 was 3,046 <br />gallons, printout provided by Pete Chahoud. The inventory level in the diesel tank on March 22, 2018 was 787 <br />gallons, printout provided by Pete Chahoud. I placed a new Nylon Tamper Resistant Strap on the diesel fill pipe on <br />March 22, 2018. No person shall remove, deface, alter, or otherwise tamper with a red tag so that the information <br />contained on the tag is not legible. Ensure that red tags are not tampered with. <br />This is a Class I violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by April 22, 2018. <br />NOTE: <br />March 22, 2018 - the 110 -octane and 100 -octane tanks previously red tagged on September 19, 2017. <br />Diesel, 87-1 octane, 87-2 octane, and 91 octane red tagged today during site visit. <br />March 23, 2018 - I was on site to verify diesel fill container testing. I removed the Nylon Tamper Resistant <br />Strap and Red Tag bag for the service technician to conduct the testing. After the diesel spill container testing, <br />the red tag bag was replaced on the diesel fill pipe and a new Nylon Tamper Resistant Strap <br />was placed on the bag.
