In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The site must be brought into compliance to avoid your entire UST system being red tagged - 7 -days from the receipt of this <br />Notice. Outstanding violations include but are not limited to the following: <br />1. A permit to operate the UST system (all tanks) has not been issued, in addition, permit fees have not been paid. <br />No person may own or operate an UST unless a permit for its operation has been issued by the local agency to <br />the owner or operator of the UST system (HSC 25284). <br />2. Failure to comply with UST operating permit conditions (CCR 2712). <br />3. UST system incapable of detecting leak from primary into secondary containment (pre -July 2003) (HSC 25291(b)). <br />4. Failure to construct, operate, and maintain primary containment as product tight (HSC 25290.1, 25290.2, 25291). <br />5. Current monitoring plan approved by the EHD not found on site.
