In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The site must be brought into compliance to avoid your entire UST system being red tagged - 7 -days from the receipt of this Notice. <br />Outstanding violations include but are not limited to the following: <br />A permit to operate the UST system (all tanks) has not been issued, in addition, permit fees have not been paid. The Board of Equalization <br />(BOE) account number 44037432 is not active person may own or operate an UST unless a permit for its operation has been issued by the <br />local agency to the owner or operator of the UST system (HSC 25284 and HSC 25286(c)) <br />2, The 100 and 110 -octane underground storage tank systems were found to be illegally abandoned (HSC 25298(b)). <br />3. The 100 -octane fuel spill container failed to contain a minimum capacity of five gallons (CCR 2635 (b). <br />4.
