I other entities acting by,through,under,or on behalf of Defendant and all persons in concert with or <br /> 2 participating with said Defendant with actual or constructive knowledge of this injunction,only <br /> 3 insofar as they are doing business in the State of California and confined to GASOLINE <br /> 4 SALES/MINI-MART activities of Defendant, COUNTRY MART DIESEL&GAS in the County of <br /> 5 San Joaquin and elsewhere in the State of California. <br /> 6 3. Defendant,in the course of GASOLINE SALES/MM-MART activities of Defendant, <br /> 7 COUNTRY MART DIESEL&GAS, are pursuant to Health and Safety Code section 25100 et seq., <br /> 8 hereby permanently enjoined from: <br /> 9 a. Failing to maintain modified emergency coordinator information, in violation of <br /> 10 California Code of Regulations,title 22 section 66262.34(4)(2); <br /> 11 b. Failing to label or mark containers used for onsite accumulation of hazardous <br /> 12 waste, in violation of California Code of Regulations,title 22 section 66262.34(f); <br /> 13 c. Failing to train facility personnel in hazardous waste management procedures <br /> 14 relevant to the positions in which they are employed, in violation of California Code of Regulations, <br /> 15 title 22 section 66265.16; <br /> 16 d. Failing to maintain and operate facility to minimize the possibility of a fire, <br /> 17 explosion,or any unplanned sudden or non-sudden release of hazardous waste,in violation of <br /> 18 California Code of Regulations,title 22 section 66265.31; <br /> 19 e. Failing to keep container holding hazardous waste closed during transfer and <br /> 20 storage, except when it is necessary to add or remove waste, in violation of California Code of <br /> 21 Regulations,title 22 section 66265.173(a); <br /> 22 4. Defendant,in the course of Defendant's GASOLINE SALES/MINI-MART activities, are <br /> 23 pursuant to Health and Safety Code section 25280 et seq.,hereby permanently enjoined from: <br /> 24 a. Failing to annually test the spill containment structure, in violation of Health and <br /> 25 Safety Code section 25284.2; <br /> 26 2 <br /> 27 <br /> 28 PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
