County Side Mini Mart <br /> 14971 N.Hwy 88 <br /> Lodi,Ca 95240 <br /> Response to San Joaquin County Routine and monitoring System Certification <br /> Underground Storage tank inspection dated 04/25/11. <br /> The first point on page 3 refers to LE alarms from 2-21-06.This alarm has been on the record since <br /> before the current owners took possession of the facility.Consequently they could not be responsible <br /> for maintenance records prior to their ownership.It has not been test each of the prior years during the <br /> annual testing that only a licensed tester is responsible for and that the COPA supervised.The alarm <br /> indicates that it is an annular alarm.This was possibly an alarm created by a technician during a setup <br /> that was not used again.Since it isn't properly labeled and the System only has Ll to L6 in its system <br /> setup.This assumption of a previous setup use or test is logical and the fact that there is already an <br /> interstitial sensor on the system. <br /> A copy of the Designated Operator report for 1/9/08 is attached to show that the alarm has been <br /> consistently the same and none active.Three years of designated operator reports are not present In <br /> the binder since they only need to be kept for a year as indicated in Title 23 which can be seen below. <br /> The current owner is working on maintaining their records but are not responsible for what took place <br /> prior to their assumption of ownership. <br /> I.Code Regs.Title 23,Division 3,Chapter 16,Underground Tank Regulations <br /> (d)The designated UST operator(s)shall provide the owner or operator with a copy of each monthly <br /> inspection report,and alert the owner or operator of any condition discovered during the <br /> monthly visual inspection that may require follow-up actions. <br /> (a)The owner or operator shall maintain a copy of the monthly inspection record and all attachments <br /> for the previous twelve months.The records shall be maintained on-site or,if approved by the <br /> local agency,off-site at a readily available location. <br /> (4)Permits may be transferred to new underground sWags tank owners it(1)then underground <br /> storage tank owner does not change conditions of the permit(2)the transfer Is registered with <br /> the local agency within 30 days of the change in owriership,and(3)state permit application <br /> forms are completed to show the changes.Transferred its shall expire and be renewed on <br /> the original expiration date.A local agency may review,moctify,or terminate the permit to <br /> operate the underground storage lank upon receiving an ownership transfer request. <br /> (a)The local agency shall not renew an unclerground storage tank permit unless the underground <br /> storage tank has bow inspected by the local agency ora special inspector within the previous <br /> 12 months and the inspection verified that the underground slorage tank complied with the <br /> provisions of Article 3 or 4,as applicable,and with all existing permit conclitions.The inspection <br /> shall be conducted as speeffied in section 25288 of Chapter 6.7 of Division 20 of the Health and <br /> Safety Code If the inspection indicated noncompliance then the local agency shell verify by a <br /> follow-up Inspection that all required corrections have been Implemented before renewing the <br /> permit <br /> 09C92966M 9C:60! 11-H-tO <br />
