Lincoln St., Stockton <br />Program: UST <br />SUMMARY OF VIOLATIONS <br />CLASS I CLASS 11 or MINOR -Notice to Comply) <br />ROUTINE ANNUAL INSPECTION AND MONITORING SYSTEM CERTIFICATION <br />Violations: (21, 23b, 23d) <br />21. Liquid was observed in the diesel piping sump. If water could enter into the secondary containment <br />by precipitation or infiltration, it must be removed and disposed of properly. Immediately remove this <br />liquid, make a hazardous waste determination per Title 22 hazardous waste regulations, and manage it <br />accordingly. Ensure that the diesel piping sump is maintained free of liquid. Liquid was removed by the <br />technician on site. <br />23b. Doug Smith performed the November 2010, December 2010, January 2011, and February 2011 <br />monthly inspections and did not have a current ICC certification at the time of the inspections. Mr. <br />Smith's ICC certification expired on November 11, 2010. A designated operator shall have current ICC <br />certification at the time of the monthly inspections. Ensure that any designated operator who performs <br />monthly inspections at this facility has current ICC certification, and submit a statement of designated <br />operator listing a current ICC certified designated operator for this facility by April 10, 2011. <br />23d. This facility did not have any designated operator trained employees between November11, 2010 <br />and March 9, 2011. The designated operator employee training for all UST trained employees was <br />conducted on April 2009 and November 11, 2009 and then again on March 9, 2011. The designated <br />operator who conducted the March 2011 training, Doug Smith, did not have a current ICC certification at <br />the time of training. The designated operator shall train facility employees for which he or she is <br />responsible in the proper operation and maintenance of the UST system once every 12 months. The <br />training shall include, but is not limited to: <br />1. Operation of the UST system in a manner consistent with the facility's best management practices <br />2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan <br />3. Employee's role with regard to spills and overfills as specified in the facility's response plan <br />4. Name of the contact person(s) for emergencies and monitoring equipment alarms <br />Ensure that employees have been trained by a current designated operator, maintain the list on site, and <br />submit a copy of the training records to the EHD by April 10, 2011. <br />REPEAT VIOLATION <br />Complete and submit a copy of the Return to Compliance Certification to the EHD by April 10, 2011 <br />along with a statement documenting the corrective actions that have been or will be taken for each <br />violation and any supporting paperwork. <br />ALL EMD STAFF TIME ASSOCIATED WITH FAWNG TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122). <br />THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT Y-HDIS CURRENT HOURLY RATE. <br />EHD Ins pe <br />Reaei B : <br />Title < <br />EHD 23-02-003— Ret 08/10/10 v CONTINUATION FORM <br />
