Lacked a check mark indicating secondary containment
testing is performed every 36 months and the flapper valve is set at 95% of tank capacity as overfill
protection.
Resolution 1: A revised and updated UST Monitoring Plan has been prepared and attached which includes
addition of the Fill Sump sensor model number, Section VII. An X indicating the secondary containment
system is tested every 36 month, and the Flapper valve is set to 95% capacity of the tank.
Item 2: On your inspection report you stated that the 89 turbine sump contained water. You requested
that the water be removed and repairs be conducted to prevent water intrusion.
Resolution 2: On 5/9/2011 Walton Engineering was on site to resolve the water intrusion. While on site
they replaced all of the man -way gaskets, cleared debris out of the sump lid track, and cleared debris and
silt from the water shed around the top of the sump. This is believed to be what was necessary to resolve
this item. Attached is an after photo showing the work completed.
This letter should address the item(s) noted on the Inspection Report. 7 -Eleven assumes that all issues
regarding this report have been resolved and are closed. The submittal of this response by 7 -Eleven, Inc.
shall not constitute, nor be deemed to constitute, an admission of liability or responsibility with respect to
the alleged violations and, in addition, evidence of this settlement may not be used in any administrative or
judicial proceeding or otherwise.
7 -Eleven, Inc.
P.O.
