SAN J O A Q U I N Environmental Health Department <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: FEDEX Date: Apr 01, 2019 <br /> RP Mailing Address: 6900 ALCOA RD Record ID#: C00049558 <br /> Benton,AR 72015- Program Element 2546 <br /> Spill Location: 850 ROTH RD, LATHROP Release/Spill Response (excluding Joint Team) <br /> NATURE OF WASTE DISCHARGE/WASTE RELEASE: <br /> A saddle tank was punctured causing the release diesel fuel onto asphalt. <br /> OBSERVATIONS: <br /> Diesel fuel was observed near the railroad on the western side of the tracks. It was not observed on the eastern side of the <br /> tracks going westbound. The diesel trail went through the first gate at 700 Roth Rd and ended at the second gate near <br /> building 550. Absorbent was put on the areas where the truck stopped at the gate houses. There are several diesel <br /> saturated areas where the truck stopped en route to the second gate house. A contractor hired by the responsible party is <br /> currently mobilizing to complete the cleanup. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit all disposal records and analytical results to the EHD. <br /> ° Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
