SAN J O A Q U I N Environmental Health Department <br /> —COUNTY- <br /> WASTE DISCHARGE/SPILL RESPONSE <br /> NOTICE TO ABATE <br /> Responsible Party: ON TRACK TRANSPORTATION INC Date: Jul 03, 2019 <br /> RP Mailing Address: 2701 E HAMMER LN#112 Record ID#: COON4AXUL <br /> Stockton, CA 95210- Program Element: 2546 <br /> Spill Location: NB 1-5 AT ELEVENTH ST, TRACY Release/Spill Response(excluding Joint Team) <br /> NATURE OF WASTE DISCHARGEfWASTE RELEASE: <br /> A semi-truck crash caused the release of 120 gallons of diesel fuel. <br /> OBSERVATIONS: <br /> Diesel staining was observed on the ground where the semi-truck crashed. A 150 gallon diesel tank on the passenger side <br /> was approximately 3/,full. The fire department contained the release by plugging the hole in the tank. The tank still had a <br /> slow drip. Due to the debris from the crash, it was unknown how far the release had spread. No waterways or storm drains <br /> were impacted. The CHP officer in charge of the incident was Daniel Garza and the Caltrans Hazmat person on site was <br /> Juan Armendarez. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> ° Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> ° Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Send final disposal records to the EHD. If any waste is deemed non-hazardous, submit documentation with the <br /> disposal records showing how the complete hazardous waste determination was made. <br /> ° Other Correction <br /> COST RECOVERY: All EHD time associated with this Spill Response is billed to the responsible party at the current hourly <br /> rate.
