SAN JOAQUIN -:aU; i y Environmental Health Department AMENDED 116/2020 Large Quantity Hazardous Waste Generator Inspection Report Facility Name: Facility Address: 1 Date: PEP BOYS #562 1401 S CHEROKEE LN, LODI December 20, 2019 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) Item # Remarks 117 CCR 66265.16 Failed to maintain complete hazardous waste training records. OBSERVATION: A. The business operator could not produce documentation during the inspection that demonstrates employees have complete hazardous waste training as specified in this section. B. At the time of inspection, it could not be demonstrated that employees who handle hazardous waste were properly trained, based on the following observations: 1. An open unlabeled grey tote was observed next to the facility's cardboard bailer and contained the following items (see photos IMG 9921-37): - a used Lexmark printer ink cartridge - at least 15 aerosol cans of automobile paint and/or other chemicals - at least eight 8 -fl oz USC Garage Final Finish or Flexible Glaze for automobiles - at least two 32 -fl oz pail of VHT Flame Proof Silica ceramic coating - a 1 -gal pail of Dupli Color Truck Bed Coating According to Chris Sehneider, Parts Manager, the items listed above are defective and are waiting to be processed and placed into the appropriate hazardous waste totes (each labeled as either ignitable flammables, corrosive bases, corrosive acids, ignitable oxidizers, toxic, or universal waste) located in the nearby hazardous waste storage area (IMG 9948). Chris indicated that the defective items listed above began accumulating 1-2 weeks ago. 2. A shelf labeled "Defective Merchandise," located next to the hazardous waste storage area near the store's break room, contained, but was not limited to, the following items (IMG9940-47): - an 8 oz container of Slime Rubber Cement, with a barcode label marked "Defective" and dated 9/16/2019; - an 8 oz aerosol can of Dupli Color Perfect Match automotive paint, with a barcode label marked "Defective" and dated 6/3/2019; - a 12 oz aerosol can of Dupli Color Engine Enamel with ceramic, which was missing it's cap and had dried leakage beneath the nozzle; a - an 11 oz aerosol can of Dupli Color CustomWrap Removable Coating, which was missing it's cap. - at least six bottles of Castrol Automatic Transmission Fluid According to Chris Sehneider the items listed above, with exception to the six bottles of Castrol transmission fluid, are defective and are waiting to be processed and placed into the appropriate hazardous waste totes located in the nearby hazardous waste storage area (IMG 9948). 3. An open grey tote labeled "Returns Service" and located under a front register, contained a partially filled aerosol can of VHT Flame Proof Primer (IMG 9916, 9918-20). The aerosol can was missing it's actuator/nozzle and was labeled as "Extremely Flammable." It was unclear how long ago the aerosol can had been placed in the "Returns Service" tote. According to the facility's Hazardous Waste Training Guide, posted in the hazardous waste storage area next to the store's break room, items that are partially full and/or are missing the nozzle/cap are identified as waste, and flammable aerosols are identified as Hazardous Waste Aerosols, Flammables, and Combustibles (AF) (IMG 9948-59). At the time of inspection, hazardous waste storage area, located next to the store's break room, had an empty tote designated for Ignitable Flammable (FL) Hazardous Waste. 4.
