The business operator could not produce documentation during the inspection that demonstrates employees <br />have complete hazardous waste training as specified in this section. <br />B. At the time of inspection, it could not be demonstrated that employees who handle hazardous waste were <br />properly trained, based on the following observations: <br />1. An open unlabeled grey tote was observed next to the facility's cardboard bailer and contained the following <br />items (see photos IMG 9921-37): <br />- a used Lexmark printer ink cartridge <br />- at least 15 aerosol cans of automobile paint and/or other chemicals <br />- at least eight 8 -fl oz USC Garage Final Finish or Flexible Glaze for automobiles <br />- at least two 32 -fl oz pail of VHT Flame Proof Silica ceramic coating <br />- a 1 -gal pail of Dupli Color Truck Bed Coating <br />According to Chris Sehneider, Parts Manager, the items listed above are defective and are waiting to be processed <br />and placed into the appropriate hazardous waste totes (each labeled as either ignitable flammables, corrosive <br />bases, corrosive acids, ignitable oxidizers, toxic, or universal waste) located in the nearby hazardous waste storage <br />area (IMG 9948). Chris indicated that the defective items listed above began accumulating 1-2 weeks ago. <br />2. A shelf labeled "Defective Merchandise," located next to the hazardous waste storage area near the store's break <br />room, contained, but was not limited to, the following items (IMG9940-47): <br />- an 8 oz container of Slime Rubber Cement, with a barcode label marked "Defective" and dated 9/16/2019; <br />- an 8 oz aerosol can of Dupli Color Perfect Match automotive paint, with a barcode label marked "Defective" and <br />dated 6/3/2019; <br />- a 12 oz aerosol can of Dupli Color Engine Enamel with ceramic, which was missing it's cap and had dried leakage <br />beneath the nozzle; a <br />- an 11 oz aerosol can of Dupli Color CustomWrap Removable Coating, which was missing it's cap. <br />- at least six bottles of Castrol Automatic Transmission Fluid <br />According to Chris Sehneider the items listed above, with exception to the six bottles of Castrol transmission fluid, <br />are defective and are waiting to be processed and placed into the appropriate hazardous waste totes located in the <br />nearby hazardous waste storage area (IMG 9948). <br />3. An open grey tote labeled "Returns Service" and located under a front register, contained a partially filled aerosol <br />can of VHT Flame Proof Primer (IMG 9916, 9918-20). The aerosol can was missing it's actuator/nozzle and was <br />labeled as "Extremely Flammable." It was unclear how long ago the aerosol can had been placed in the "Returns <br />Service" tote. According to the facility's Hazardous Waste Training Guide, posted in the hazardous waste storage <br />area next to the store's break room, items that are partially full and/or are missing the nozzle/cap are identified as <br />waste, and flammable aerosols are identified as Hazardous Waste Aerosols, Flammables, and Combustibles (AF) <br />(IMG 9948-59). At the time of inspection, hazardous waste storage area, located next to the store's break room, <br />had an empty tote designated for Ignitable Flammable (FL) Hazardous Waste. <br />4.
