DocuSign Envelope ID:05EFDA32-4C8F-4F23-93BC-D19E217654E0 <br /> (A) do not use, possess or distribute or be impaired by alcoholic beverages or illicit/illegal <br /> drugs or misuse or distribute prescription drugs or drug paraphernalia; and <br /> (B) do not carry onto the premises or possess weapons of any type, including firearms. <br /> (ii) CONTRACTOR agrees that entry onto COMPANY GROUP WORKSITES constitutes consent for <br /> COMPANY GROUP and its authorised representatives to make announced or unannounced <br /> searches of persons, including periodic drug/alcohol testing, or property. Searches may <br /> occur on entering or while on those premises or at embarkation points such as heliports or <br /> maritime terminals. Unless otherwise agreed in writing by COMPANY, CONTRACTOR will <br /> ban from COMPANY GROUP WORKSITES any CONTRACTOR PERSONNEL who fail to <br /> cooperate with or test positive during searches or periodic drug/alcohol testing. <br /> CONTRACTOR will communicate such policy and its substance abuse policy and/or DISA <br /> Consortium guidelines to all CONTRACTOR PERSONNEL. <br /> (iii) CONTRACTOR must have in place at its own expense a substance abuse policy acceptable to <br /> COMPANY, meeting applicable STANDARDS OF PRACTICE. STANDARDS OF PRACTICE for a <br /> substance abuse policy include, at a minimum: (A) meeting DOT standards for regulated <br /> testing; (B) random, for cause, and follow-up testing; (C)fitness for duty standards, <br /> including medical clearance, applied prior to rehabilitated individuals returning to work <br /> (only if applicable per DISA); (D) monitoring of continued fitness of individuals permitted to <br /> return to work(only if applicable per DISA); and (E) supervisory training on random and for <br /> cause testing and stand down procedures. <br /> (iv) CONTRACTOR is required to perform pre-employment/pre-access hair testing where <br /> CONTRACTOR PERSONNEL will be on COMPANY GROUP WORKSITES in safety sensitive <br /> positions, which are those positions requiring exercise of independent action and which <br /> result in direct and immediate irreversible effects; and which can create risk of serious <br /> physical injury to the individual, other individuals or the general public, or significant <br /> environmental damage. <br /> (v) COMPANY may specify that CONTRACTOR will participate at its expense in substance abuse <br /> prevention consortiums such as DISA Contractors Consortium to effectively manage and <br /> reduce testing redundancy. <br /> (d) 33 CFR Parts 101-106, Maritime Security, 6 CFR Part 27, Chemical Facility Anti-Terrorism <br /> Standards ("CFATS"),49 CFR Part 1520 (Protection of Sensitive Information), other APPLICABLE <br /> LAWS, or COMPANY GROUP requirements may apply to certain COMPANY GROUP facilities or <br /> operations. Where applicable because CONTRACTOR will perform at least part of SCOPE at <br /> COMPANY GROUP WORKSITES, or will handle COMPANY GROUP's products or materials, <br /> CONTRACTOR will become informed of and comply, at its own expense,with these and similar <br /> requirements for(i) security; (ii) handling of sensitive security information; (iii) screening of <br /> individuals through the Department of Homeland Security database and other databases; (iv) <br /> advance provision for entry credentials; (v) security compliance training; (vi) conduct of required <br /> CONTRACTOR PERSONNEL pre-assignment background investigations; and (vii) related matters. <br /> (e) CONTRACTOR will at its own cost reasonably cooperate with COMPANY's efforts to minimise <br /> tariffs and duties owed for imports from countries with "Free Trade" agreements ("FTA")with the <br /> US (listed at http://www.ustr.gov/trade-agreements/free-trade-agreements). In those cases,for <br /> Purchase Contract—GOODS and SERVICES <br /> Ver.2016a 15 <br />
