DocuSign Envelope ID:05EFDA32-4C8F-4F23-93BC-D19E217654E0 <br /> SECTION IV—SCOPE DESCRIPTION <br /> The services for the mitigation of environmental impact caused by hazardous substance shall include <br /> but not be limited to the following: <br /> • Containment, neutralization decontamination recover, cleanup and repackaging of materials; <br /> • Site assessment and site restoration; <br /> • Transportation storage treatment or disposal of waste; <br /> • Engineering and technical services, including sampling analysis, design, engineering, construction; <br /> or any other related services; <br /> • Environmental consulting, preparedness evaluation, or any other related consulting services. <br /> • Site safety services as requested. <br /> Upon notice from Company of a spill or response need, Contractor shall immediately notify <br /> Company of Contractor ability to provide an immediate response, however if an immediate response is <br /> not possible then Contractor shall notify company within a time agreed to by both parties. Contractor <br /> shall perform the work in accordance with the terms and conditions set forth in this Agreement and any <br /> Orden at such places described by Company, and Company shall pay Contractor for the work actually <br /> performed in accordance with tens set forth in this Agreement and the relevant order.. <br /> Contractor shall maintain a 24 hour. 7 days a week telephone service to respond to emergency calls. <br /> Personnel will be dispatched to specified locations upon notification by authorized Company personnel. A <br /> first, second and third number and contact person will be available for every work location covered by <br /> this agreement. <br /> In performing the Contractor shall provide all necessary labor, supervision procurement and <br /> coordination of subcontractor work permits (except those provided by or in the name of Company), <br /> machinery, equipment tools, fuels, supplies (except those provided by Company) and transportation for <br /> the performance of the Work. <br /> Contractor shall maintain the appropriate United States Coast Guard Oil Spill Response Organization <br /> (OSRO) classification to respond to an incident at the specific Company facilities for which they have been <br /> identified. <br /> Contractor shall maintain a maximum 1-hour response time where identified as the primary response <br /> provider to meet regulatory requirements found in 40 CFR 112. <br /> Contractor shall provide evidence of OSRO classification as well as proof of equipment deployment <br /> exercises to the Company for assurance purpose annually. <br /> All materials and equipment furnished by the Contractor and ail Work performed by Contactor and its <br /> subcontractors shall be subject to inspection by company who shall have access at ail reasonable times, <br /> upon notice to Contractor and when accompanied by a representation of Contractor. Company's <br /> inspection shall not constitute acceptance of patent defects or relieve Contractor from any duties, <br /> obligations, or liabilities under this agreement associated with such defects. Neither company's review <br /> nor acceptance of Contractor's drawings, plans, or Wort specification, nor Company's monitoring of <br /> shall relieve Contractor of any obligations under thig agreement. <br /> Company shall have the right, but not the obligations to periodically review contractors operation for <br /> the purpose of monitoring Contractor compliance with the health. safety, security and environmental <br /> requirements. Such reviews shall not relieve the Contractor of its responsibility for protecting the safety <br /> and health of ail personnel nor shall they constitute an obligation on the part of Company to enforce <br /> compliance.
