The Department of Toxic <br /> Substances Control (DTSC) has reviewed and approved this company's application to <br /> be a Certified Appliance Recycler (CAR). After reviewing and approving a CAR <br /> application for conformance with section 25211.4 of the Health and Safety Code, DTSC <br /> is required to transmit all application documents to the Certified Unified Program <br /> Agency (CUPA) in whose jurisdiction the business or person is located. <br /> The CUPA is required to inspect the CAR facility "as soon as is practicable" to <br /> determine whether the recycler is capable of properly removing and managing all <br /> Materials that Requires Special Handling (MRSH) from major appliances (Health & <br /> Safety Code § 25211.4(d)). The statute requires CUPAs to consider the working <br /> condition of the equipment, the technical ability of the employees, and the facility's <br /> compliance with existing law (Health & Safety Code § 25211 et seq., and Pub. <br /> Resources Code § 42160 et seq.). <br /> Please refer to the DTSC Fact Sheet entitled "AB 1447 (2007) Changes to the <br /> Appliance Recycling Program" (available on our CAR Web page) for a summary of <br /> existing law. In summary, an appliance recycler must be certified by DTSC prior to <br /> removing MRSH and discarding major appliances. MRSH may not be disposed of in <br /> the garbage or at a solid waste facility. <br /> The law also prohibits anyone from transporting, delivering, or selling discarded major <br /> appliances to a scrap recycling facility unless one of three conditions is met- <br /> 40 Printed on Recycled Paper <br />
