State of California—California Environmental Protection Agency <br /> SUMMARY OF VIOLATIONS <br /> Department of Toxic Substances Control <br /> Facility Name: Thatcher Company of California Date: 2/15/2019 <br /> Continuation Sheet for SECTION 1 <br /> NON - MINOR VIOLATIONS AND REQUIRED CORRECTIVE ACTION <br /> solution (i.e. proper labeling describing the hazards of the contents, and a lid <br /> to minimize the risk of spills and inhalation of toxic and/or corrosive chemicals <br /> by workers). <br /> 2. Per Cal. Code Regs, title 22, section 66262.34(a); a facility may accumulate 1 <br /> hazardous waste on site for 90 days or less without a permit or grant of interim <br /> status, provided that the hazardous waste is properly contained and labelled and <br /> follows all other requirements of the section. A generator who fails to meet these <br /> requirements must then store the hazardous waste per California Health and <br /> Safety Code (HSC) section 25123.3(b)(4). <br /> TCS violated HSC §25189.5(d), storage of hazardous waste at a facility, area, or <br /> point without a hazardous waste facilities permit or other grant of authorization <br /> from the Department, to wit: on November 28, 2018, 1 observed the following: <br /> A. During the facility walk-through, in the Empty Tote Storage Area outside, we <br /> observed four yellow, 5-gallon buckets of hydrotest wash water from <br /> hydrotesting compressed gas cylinders that once held chlorine gas. The <br /> wash water in the buckets was rust-brown and contained solids (soil or <br /> metals). A pH strip indicated a pH of approximately 2. pH measurement of <br /> the collected sample was determined by ECL-Berkeley to be approximately <br /> 1.37. The sample was also hazardous in the soluble metals test for <br /> chromium, copper, lead and nickel. The corrosive solution was illegally <br /> stored because the bucket lids were not firmly closed, and they were not <br /> labeled with proper hazardous waste labels containing an accumulation date <br /> showing how long the solution had been stored (Sample ID TCS-06). <br /> Corrective Action: Within 30 days of the date of this SOV, please provide <br /> photographic evidence to show that the hydrotest wash water generated from <br /> hydrotesting compressed gas cylinders is routinely and properly stored as a <br /> DTSC 1665(11/1212014) Page 3 of 6 <br />
