Present at the meeting were property owners
Erlinda and Vicente Hernandez, Arthur Deicke from consulting firm Advanced Geo Environmental, Inc.,
and Laurie Cotulla, Margaret Lagorio and Lori Duncan from SJC/EHD. Several issues summarized
below were discussed at the meeting.
The Hernandez's have begun the investigation of their former UST site with the installation of three
groundwater monitoring wells. However, routine quarterly monitoring, sampling and reporting of
analytical results from these wells was not being done. The Hernandez's are currently appealing a
fund manager decision from the State Water Resources Control Board (SWRCB)denying them
eligibility to the Cleanup Fund. SJC/EHD explained to the Hernandez's that their responsibility under
state regulation to continue the investigation and clean up of their site is not contingent upon their
status of eligibility to the Cleanup Fund, and that they must stay in compliance with regulatory
directives to conduct, and report, routine quarterly groundwater monitoring and sampling of this site.
A nearby contaminated UST site is currently investigating the extent of their plume. It is possible this
plume has migrated onto the Hernandez's property, but more data is required to determine this.
SJC/EHD directs the Hernandez's to continue with routine quarterly groundwater monitoring, sampling
and reporting of their site while the neighboring investigation continues. SJC/EHD must be notified at
least 48 hours prior to all site fieldwork. Reports of finding must be submitted within 60 days following
completion of the work to SJC/EHD and Geotracker, the SWRCB's Internet database.
SJC/EHD staff will be discussing this site and a nearby contaminated UST site with the Central Valley
Regional Water Quality Control Board, since the contamination from the two sites may have
commingled Qoined together). If you have any questions, comments or changes to this summary
please call Lori Duncan at(209)468-0337.
Donna Heran, REHS, Director
Environmental Health Department
l,ln 1ctnn-mow. 64
Lori Duncan, Senior REHS Margaret gorio, REHS
LOP/Site Mitigation Unit IV Program Coordinator, Unit IV
cc: James Barton, CVRWQCB
Art Deicke, AGE
