Box 944212
Sacramento, CA 94244-21201
Subject: Petition for Final .bivision l7ecisiora (FDD)USTCF Claim .No. 0182:19
3012 Waterloo Road, Stockton, California
Dear Ms. Evoy.
. In accordance with a letter froth the State Water Resources Control Roacd - nivisi
Assistance dated September 15'..2006, we are formally requesting a Final Division Ueci of
Financial
regarding the Eligibility Determination Cor C:lairn No, 018239. s n(Fn1))
The following infortna.tion is submitted:
I• The Fund Manager's Decision to cietennine my site incligiile has damaged me financials.
Without access to the Underground Storage Tank:Cleanup Fund,l will be unable to pay for
the necessary assessment and.potential Cleanup of cont:aarni.iiation associated wit1T the fornier
underground storage tanks(US's',,). My wife and 1 are retired and on very lint ted income,of
which, the property is a fart.
At the time of purchase io tb.c site, in 1983, I was not made aware of the presence of 1151's
nor the associated reg(irenients. Furthermore, in 1983 there was essentially no "due
diligence"requirements rcg irding theurchasin
purchasing of con, more ial properties.Additionally it
is my understanding thatlicre were no specific UST laws governing.sites at the that time nor
was there any oversight agency in San Joaquin County responsible for USTs. Ifl had known
about the tanks and the specific req uirenicnt,s,l would have made arrangement to resolve the
issue sooner.
When approached by the San Joaquin Privirotunerital IIcalth. Department regarding the
apparent presence of the US'ts, 1 made efforts to "bring the site into compliance" and
performed every task required by the SJFIID, including the payment ol.'cunent and"hack"
tattle fees. During this Process, I repeatedly inquired with. the S.if HD in regards to any
additional efforts required and was told by Mr.Doug Wilson(now retired)that"everything
was in order"and that, i.f necessary, f would qualify for the "cleanup fund"_ I feel that the
S.iF...IID(the lead oversight agency under contract from the State) misled me regarding the
status of the site and my Ootentia.l eligibility, adding to rtty"damage".
1
i
2. The desired remedy for the FDD would be to allow access
and eligibility to the i.fn.dcrground
Storage 'Tank Clcanup Fund so that site could be appropriately assessed and, if necessary,
