The burden, including costs, of these reports shall bear a reasonable <br /> relationship to the need for the report and the benefits to be obtained from the reports. In requiring <br /> those reports, the regional board shall provide the person with a written explanation with regard to the <br /> need for the reports, and shall identify the evidence that supports requiring that person to provide the <br /> reports. " <br /> Section 13268 (b)(1)of the CWC states "Civil liability may be administratively imposed by the regional <br /> board in accordance with Article 2.5 (commencing with Section 13323) of Chapter 5 for a violation of <br /> subdivision (a) in an amount which shall not exceed one thousand dollars ($1,000)for each day in <br /> which the violation occurs." <br /> The Discharger owns and operates the facility subject to Waste Discharge Requirements (WDRs) Order <br /> No. 87-184, and the technical reports required herein are necessary to assure compliance with the WDRs <br /> and to ensure the protection of the underlying groundwater. <br /> Therefore,pursuant to Section 13267 of the CWC, Robert Mondavi Corporation shall submit the <br /> following reports. All required technical plans and reports must be prepared by or under the direction of <br /> a California Registered Engineer or Registered Geologist;and shall contain a statement of qualifications <br /> of the responsible licensed professional(s) as well as the professional's signature and/or stamp of the <br /> seal. It is noted that Mondavi's consultants have recently agreed that the following due dates represent <br /> an acceptable schedule. <br /> 1. By 1 November 2004, Robert Mondavi Corporation shall submit a Groundwater Protection <br /> Workplan that provides a detailed description of the investigations and reports required by Items 2 <br /> through 4 (below)to evaluate current conditions, estimate future conditions, and identify and <br /> implement the improvements necessary to protect groundwater quality. Regional Board staff must <br /> approve the plan prior to its implementation. The Workplan shall include: <br /> a. A Wastewater Characterization and Wastewater System Evaluation Workplan that describes an <br /> evaluation of the wastewater system, including sampling and analytical activities. The purpose <br /> of this plan will be to gather the information necessary to identify system limitations and <br /> evaluate potential system upgrades to protect underlying groundwater from degradation by the <br /> discharge of process wastewater. The plan shall identify the location at which samples will be <br /> collected, sampling frequency, and constituents to be analyzed. <br /> The plan shall address those activities that will be conducted to define seasonal variations in the <br /> nature and strength of wastewater from various sources, including the production process, the <br /> water softening process, cooling water discharges, and any other processes that could have a <br /> significant influence on wastewater characteristics and groundwater quality. The plan shall also <br /> address those activities that will be conducted to evaluate the treatment capabilities of the <br /> facultative pond system;the vineyard irrigation and disposal system, and any other treatment and <br /> disposal processes that could have a significant influence on groundwater quality. <br /> California Environmental Protection Agency <br /> CA Recycled Paper <br />
