There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the contents in the drum and <br /> manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other <br /> knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in <br /> Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a Class II violation. <br /> 115 CCR 66262.40(a)Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: Hazardous waste generator signed copies of Uniform Hazardous Waste Manifest(UHWM) <br /> numbers: 016653708JJK(12/21/2016), 016645470JJK(3/9/2017), 017154250JJK(6/22/2017), 017154370JJK <br /> (6/30/2017), 017144867JJK(10/10/2017), 018141715JJK(1/16/2018), 018144970JJK(4/26/2018), 019560665JJK <br /> (9/20/2018), 019743201JJK(12/5/2018), 020022600JJK( 1/23/2019), 020242233JJK(2/19/2019), 020606548JJK <br /> (3/29/2019), and 020555723JJK(6/11/2019)were not found on-site. <br /> In addition,the facility did not have any disposal records from 12/2/2016-12/2/2019 for used oil, paper oil filters, and <br /> oily absorbent. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. <br /> CORRECTIVE ACTION: Locate a copy of the generator signed manifests listed above and any missing hazardous <br /> waste disposal records from 12/2/2016-12/2/2019 and send a copy to the San Joaquin County Environmental <br /> Health Department(EHD).
