insofar as they are doing business in the State of California and confined to Defendant's METAL <br />RECYCLING activities in the County of San Joaquin and elsewhere in the State of California. <br />3. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's METAL RECYCLING <br />activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br />Disposing or causing the disposal of a hazardous or extremely hazardous waste at a <br />point which is not authorized, in violation of Health and Safety Code section 25189(d); <br />Transporting or causing the transportation of hazardous or extremely hazardous <br />waste at a point which is not authorized, in violation of Health and Safety code sections 25189 et <br />seq.; <br />Failing to determine if that waste is a hazardous waste, in violation of California <br />Code of Regulations, title 22 section 66262.11; <br />Failing to completely label or mark each container or portable tank used for onsite <br />accumulation of hazardous waste, in violation of California Code of Regulations, title 22 section <br />66262.34(f); <br />Failing to retain a copy of each signed manifest for three years or until the <br />generator receives a signed copy from the designated facility which received the waste, in violation <br />of California Code of Regulations, title 22 section 66262.40(a); <br />Storing less than one ton of used oil filters onsite longer than one year and/or <br />storing one ton or more used oil filters onsite longer than 180 days, in violation of California Code of <br />Regulations, title 22 section 66266.130(c)(4); <br />Failing to manage lamps in a way that prevents releases of any universal waste or <br />component of a universal waste to the environment, in violation of California Code of Regulations, <br />title 22 section 66273.33(b); <br />Failing to contain any lamp in a closed container or package that is structurally <br />sound, adequate to prevent breakage, and compatible with the contents of the lamp, in violation of <br />California Code of Regulations, title 22 section 66273.33(b)(1); <br />Failing to immediately clean up and place in a closed container any lamp this is <br />1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
