S0 JOA U 1 Environmental Health Department <br /> U ; i y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> DAVE WILSON NURSERY 23223 S AUSTIN RD, RIPON June 23, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic <br /> Substances Control (DTSC)database. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of,transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA) Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> This is a minor violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: The following were located in the facility: <br /> -One work bench with a metal saw machine observed with metal fines accumulating on the machine located in <br /> maintenance shop. Operator stated that metal fines are swept up and thrown away in the garbage. <br /> -Three white 55-gallon drums with diesel exhaust fluid (DEF)labels observed partially filled with unknown contents <br /> located next to the maintenance shop behind hazardous materials shed. Operator could not make a hazardous <br /> waste determination. Operator stated that drums were left behind by previous owner. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if <br /> the metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as <br /> scrap metal. <br /> CORRECTIVE ACTION: Immediately stop disposal of metal fines generated from sawing metals, make a <br /> hazardous waste determination for the metal fines and unknown contents in the white 55-gallon drums, and manage <br /> it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to <br /> make your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR <br /> including Title 22 CCR sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
