If you or your business generates more than 100 kg of RCRA hazardous <br /> waste and/or more than one kg of acutely hazardous waste,then you need to obtain an EPA ID number.All others <br /> must obtain a State ID number. Go to the DTSC web site <br /> https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/for the form to apply for an ID number. <br /> CORRECTIVE ACTION: Immediately obtain an ID number to manage hazardous waste and submit evidence to the <br /> EHD. <br /> This is a minor violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: According to John Gutierrez, Owner,waste absorbent is thrown away into the trash. <br /> REGULATION: Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately <br /> make a hazardous waste determination for the waste absorbent, and manage it according the Title 22 hazardous <br /> waste regulations. <br /> CORRECTIVE ACTION: Submit a statement and supporting documentation explaining how this waste will be <br /> managed. Provide hazardous waste determination information if the waste absorbent is deemed non-hazardous. <br /> This is a minor violation. <br /> 119 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). <br /> OBSERVATIONS:A submission to the California Electronic Reporting System(CERS)for the hazardous waste <br /> program has not been made. <br /> REGULATION: Beginning January 1,2013, all businesses are required to submit all new(or any changes to existing) <br /> hazardous waste information online to the CERS at http://cers.calepa.ca.gov. <br /> CORRECTIVE ACTION: Immediately create a CERS account and make the required submittals.
