The Client shall provide to Sanitec and <br />Sanft6c shall collect and remove from the Clients promises, <br />transport, treat by micrmaving, or another treatment method <br />approved by al[60011,lcabld State and Federal laws and <br />regulations gov6rnIhg the disposal of Wo -hazardous, <br />Pathological, animal, phArmaceutical and chemotherapeutic <br />medical waste. <br />Reth6val Scheduling and Procedures. A schedule for medical <br />— <br />waste removal 01l. be bitAbllsfi6d'by Sanitec, which will be <br />subject Willie',, Cfienfs approval. Sanitec will Issue a Tracking <br />Document with each removal and a state -approved Certificate of <br />Destruction will be attached to the invoice When the waste is <br />billed. <br />2.0 Re6ponsiblittlesof.ClIenlL. <br />The. Client is soielY responsible for property and lawfii.ily <br />packaging, labeling and storing medical waste. The Client shall <br />store medical waste in containers supplied or approved by <br />Saniter- The Client agrees that I all containers supplied to the <br />Client by Sanilic shalf be collected and disposed of only. by <br />Sanitec or its designated representatives.- reThe storage of medical <br />waste shall be confined <br />�onfined to an area on the Clients premises to <br />which onlyiauthorized personnel shall have Access. <br />Sanitec reserves the right to decline to accept for collection, <br />transportation, treatment and/or disposal any .rqedical'waste <br />which, in Sanftc!s or its designated representatlVe' I tjuldgment,-it <br />cannot transport, treat or dispose of in a lawrul manndr or without <br />arisk of harm to public health or the environment. Improperly <br />packaged, ieAldn§, overweight or damaged containers Are <br />subject to rejection or to all' applicable charges for re -packaging <br />and/or special handling. The <br />a maximum weight per container shall <br />not exceed: 601 al reusable; 60lbM8-6ai reusable; 701bMd- <br />gal reusable:If Any container exceeds speclfied Weidht, that <br />container will be considered to be improperly packa geld, and may <br />need to be repackaged by the Client so as to be under the <br />maximum weight allowed. <br />The Client accepts the responsibility for supplies and or <br />equipment furnished by Sanitec that are in the custody and <br />control of the CJIenL <br />The Client represents and warrants that it will provide the proper <br />r6ced <br />operating pures and training lbr proper" bagging, <br />lab�r <br />packaging. Ing, marking and storage of the medical waste <br />according to, applicable state laws and regulations prior to the <br />arrive[ of Sariftdc's employees or designated representatives <br />upon the premites for removal for treatment purposes. <br />WastaZerdenin.g. It shall be the responsiblifty.of the Client to <br />ensure that Alt waste And other materials provided to Sanitec by <br />the Client for processing are generated by the Client at the <br />Clientege6en4fingfacility." Client further agrees that the waste <br />and other, rriAte6is' delivered to Sanitec by the Client , for <br />processing shall not iticlude.any '.7hazEird.ous Wattd* nor any <br />"hazAt,dous substance! as definedin applicable state laws and <br />regulations. Cli6nt further Agrees that Client shall not include in <br />the Waste arty bulk amounts of cherhotherapeutic, radlologic or <br />.radioactive waste in the bags or containers. Client also agrees <br />that the waste arid, other materials delivered to Sanitec for <br />processing shall not include metal pieces, such at loas, links of <br />chain, bolts, major bell and socket prosthesis joints, or any like <br />articles in the bags or containers. All regulated medical waste that <br />by state I#w must be incinerated must be segregated and labeled <br />in accord4nce with applicable laws. <br />Misco 0 <br />It eons. The Client shall provide all sharps to be stored <br />Prior to re oval by Sanitec in approved sharps containers. Sharps <br />containe are to be "snapped shut" No loose sharps will be <br />accepted <br />3.0 Resofisibilitles,of-Sanitec. Sanitec shall be responsible for <br />and shall provide, subject to payment of the fees specified in <br />Section 41 and the other obligations of the Client specified in this <br />Agreement the following services: <br />Waste. S6nItec or Saniteds designated representative shall <br />collect, transport, treat and dispQse.of all Waste provided by the <br />Cliendt to §aniteo in accordance and compliance with all applicable <br />federal, a and local ordinances, rules and regulations. <br />MiscelWeous. Sanitec shall: <br />(a) Maintain all required records reflecting the <br />treatment and disposal of the Waste provided to Sanitec by the <br />Client; arid provide appropriate copies to the Client. <br />(b} Obtain and maintain in effect at all times <br />during the terms of this Agreement all licenses, permits and <br />regulato uthorizations required by law in connection with <br />providin=rn <br />ical waste maragee-ritzervices contracted herein. <br />4.0 Fees', Billing and Payment for Services. <br />Fees. In 6onsideration of the services to be provided by Sanitec <br />pursuant hereto, the Client shall pay to Sanitec during the Initial <br />Term (as Idefined In Section 5 hereof), a fee based on the amount <br />of Waste Imanaged by Sanftec. <br />Sanitec!s charges are bated in part upon treatment cost, fuel cost, <br />insurance And takes in effect as of the date of this Agreement. <br />Sanftec flieiefore reserves the fight to increase charges in an <br />amount e�uai to any increases in these charges by any outside <br />agencies Inot under the control of Sanitec. <br />The C11 t will be notified In writing within thirty (30) days prior to <br />any price change(s) and wilt have the option to accept or reject the <br />price cha ige.
