Ex -Offenders on acture parole or probation, or who have been on active parole or <br />probation during the last three years preceding their employment. <br />b. Ex -Offenders required to register as a sex offender pursuant to Penal Code Section <br />290. <br />C. Ex -offenders convicto of drug trafficking in a prisonriail; escape or aiding/abetting <br />escape; battery on a Peace Officer or Public Official; arson offenses; or, any violations <br />of Penal Code Secti6ns 4570-4574 (unauthorized Communications with Prisons and <br />Prisoners Offenses). <br />I. <br />The contractor shall only employ ex -offenders who can provide written evidence of having <br />satisfactorily completed paro',e or probation, and who have remained off parole or probation, <br />and have had no arrests or crivictions within the past three years. <br />The contractor shall obtain Orior written approval from the Chief of the Office of Substance <br />Abuse Programs (OSAP) to gmploy ex -offenders in a position that provides direct supervision <br />of inmates/parolees, and who have any -conviction for any offense listed in Penal Code <br />Section 667.5(c). An ex-offe1nde'r whose assigned duties will involve administrative or policy <br />decision-making, accounting procurement, cashiering, auditing, or any other business-related <br />administrative function shallbe fully bonded to cover any potential loss to the State or <br />contractor. Evidence of such bond shall be supplied to the Chief of OSAP prior to the <br />employment of the ex -offender. <br />In addition, ex -offenders convicted of a Penal Code Section 10222.5 offense for use of a <br />firearm, or for burglary, extortion, or robbery will not necessarily be precluded employment in <br />the In -Prison Substance Abse Programs (SAPs), Substance Abuse Services Coordination <br />Agencies (SASCA), Female offender Treatment and Employment Program (FOTEP), and the <br />Parolee Services Networks (kN). The Chief of OSAP shall review such ex -offenders on a <br />case-by-case basis to determine whether or not the applicant will be approved for <br />employment. <br />Should the Department of Pe.Fsonnel Administration (DPA) post a rate change during the term <br />of this -Agreement, this Agre6ment shall be amended to reflect the new benefit rate(s) to be <br />paid to Contractors covered employees. The amendment shall be retroactive to the date the <br />rate change is posted by DPI. <br />Contractor acknowledges that failure to comply with the provisions of GC Section 19134 will <br />be deemed a material breath of this Agreement, which could subject the Agreement to <br />immediate termination at the State's sole option.' This Agreement and all documents relating <br />to implementation of GC Section 19134 are subject to audit by the Department of General <br />Services, Bureau of State Audits, and/or the State or its designee. <br />10.
