8 <br /> begin administrative procedures for closure of the landfills. <br /> These procedures will include review of LLNL's closure plan, <br /> public notice to receive comments on the plan, response to <br /> comments received, and approval of final closure plan with <br /> modifications, if necessary. <br /> Rationale For Denial of Permit to Operate <br /> Lawrence Livermore National Laboratory (LLNL) Site 300 is <br /> currently operating under federal interim status pursuant to <br /> RCRA 3005 (e) . LLNL submitted a Part A application prior to <br /> November 19, 1980. LLNL submitted the Part B Permit Application <br /> for a final RCRA permit on November 8, 1985; updated applications <br /> were submitted in July 1987 and September 1987. <br /> i <br /> An extensive review of the Part B Application revealed numerous <br /> deficiencies. On March 4, 1988, EPA issued a Notice of <br /> Deficiency (NOD) to LLNL, listing specific deficiencies in the <br /> Site 300 Part B permit application. The NOD requested LLNL to <br /> submit additional information by April 1, 1988, which LLNL failed <br /> to do. <br /> In a letter to EPA dated May 1, 1988, LLNL stated tha%i( it had <br /> -'% ..' .u^.aa k•' ," °:'m -nrr °w. . +*ww?E _nr ',,:. &x�w.,k'......- a.z®s .m`4.m'," ., ."* <br /> and un June 8, 1968, ijLNu submitted closure plans for the <br /> landfills to EPA. By letter to EPA dated June 27, 1988, LLNL <br /> formally withdrew its RCRA Part B permit application with respect <br /> to the landfills. <br /> LLNL has failed to correct the deficiencies in its application by <br /> the requested deadline, a basis for denial of a permit pursuant <br /> to 40 CFR 124.3. LLNL's withdrawal of its Part B permit <br /> application for' its landfills serves as notice to EPA that the <br /> facility does not intend to correct the deficiencies in its <br /> application, and is no longer seeking a RCRA permit to operate <br /> its landfills. <br /> For the above reasons, EPA proposes denial of LLNL's permit <br /> application for the Site 300 landfills, Pits 1 and 7. This <br /> action is governed by the procedures set forth in 40 CFR Part <br /> 124. Once the decision to deny becomes final, interim status for <br /> the landfills will terminate, pursuant to 40 CFR 270.73 . <br />
