0 <br />D <br />D <br />KLEINFELDER <br />Table 6-1 summarizes the results of this investigation. Based on these findings, there is <br />already a significant amount of soil on top of the landfills. <br />6.2.2 Proposed Future Land Use <br />J -M Mfg. has informed Kleinfelder that a portion of the site will be sold for development at <br />some point in the future. The land that will be sold is the area west of WMUs A, B and C <br />which we will call the western parcel. Although there are no firm plans, the western parcel <br />will probably be developed as an industrial area. The land retained by J -M Mfg. (the eastern <br />parcel) will continue to be used by J -M Mfg. for industrial purposes. <br />6.2.2.1 Building Activities <br />As stated earlier, some sort of industrial development is envisioned for the western parcel. <br />Specifics about the type of industry or building that would reside on the parcel are unknown. <br />J -M Mfg., in preparation for the sale of the parcel, may elect to pave portions of the western <br />parcel. Significant construction activities are not envisioned for the eastern parcel except for <br />some paving associated with capping and soil remediation during closure. <br />6.2.2.2 Deed Restrictions <br />Sale of the western parcel is planned and there is always the possibility that the eastern parcel <br />may be sold at some point in the future. Both parcels contain asbestos WMUs. Federal <br />regulations [40 CFR, Section 61.151(d)(4)(e)] state that property containing inactive asbestos <br />WMUs must have a deed restriction. Specifically the regulations state that: <br />"Within 60 days of a site becoming inactive and after the effective date of this <br />subpart, record, in accordance with state law, a notation on the deed to the <br />facility property and on any other instrument that would normally be examined <br />during .a title search; this notation will in perpetuity notify any potential <br />purchaser of the property that. <br />(1) The land has been used for the disposal of asbestos -containing <br />waste material, <br />CR14-92-12 Page 26 of 39 24-220109-P09 <br />Copyright 1992 Kteinfetder, Inc. <br />
