STMT.OF CAUFORNIA Pete Wilson,Governor <br /> CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD <br /> A800 Gil Center Drive <br /> Sacramento,Califomia 95826 _ <br /> bi <br /> February 11 , 1992 <br /> Mr. William Harris <br /> Stockton Plant Manager <br /> J-M Manufacturing Company, Inc. <br /> 1051 Sperry Road <br /> Stockton, CA 95206 <br /> Subject: Approval of Alternative Certification for J-M <br /> Manufacturing Company, Inc. , San Joaquin County, <br /> Facility No. 39-AA-0013 <br /> Dear Mr. Harris: <br /> This letter is in response to the Alternative Certification for <br /> Non-Operation or Applicability of Requirements for a Solid Waste <br /> Landfill received on January 30, 1992 , for the above facility. <br /> The alternative certification was submitted in lieu of: 1) <br /> preparing an initial cost estimate and establishing a financial <br /> mechanism for solid waste facility closure and postclosure <br /> maintenance; and (2) submitting closure and postclosure <br /> maintenance plans. <br /> Based on the information contained in the alternative <br /> certification and supporting documentation, it is the California <br /> Integrated Waste Management Board staff's determination that the <br /> above facility is, by definition, excluded from the above closure <br /> and postclosure maintenance requirements because: <br /> ► The facility is not a solid waste landfill, as defined in <br /> the Public Resources Code, Section 46027 . The facility is <br /> not required to meet the requirements of a Class III <br /> landfill pursuant to Sections 2533 and 2541 of Title 23 of <br /> the California Code of Regulations (i.e. an inert waste <br /> management unit) . <br /> ► The facility has not operated on or after January 1, 1988 . <br /> The above site, therefore, is not subject to the requirements of <br /> Title 14 , California Code of Regulations, Division 7, Chapter 5, <br /> Articles 3 . 4 and 3 . 5, Closure and Postclosure Maintenance: <br /> initial cost estimates, financial assurances, and closure and <br /> postclosure maintenance plans. <br /> Please note, however, the above site may be subject to the <br /> Disposal Site Standards, Closure and Postclosure, Title 14 CCR, <br /> Chapter 3 , Article 7 . 8 . <br /> )n Rerycled Pe,per-- <br />
