We spoke with Dr. Wang <br /> and he asked that you be copied with all correspondence between Kleinfelder and the state <br /> regarding J-M. <br /> Dr. Wang pointed out to us that the proposed draft regulations "Closure and Postclosure <br /> Maintenance Plan, Adoption Procedures, and Uniform Standards for Closure and <br /> Postclosure of Solid Waste Landfills" were issued in February 1989, by the California <br /> Waste Management Board. Page 111 7.8-6 contains a definition of"Operating:" <br /> "Operating" means active or the period of site activity from the first receipt of <br /> waste until the final receipt of waste consistent with the normal pattern of <br /> operation in the solid waste facilities permit. <br /> From this definition, it appears that J-M was not 'operating" its landfill after January 1, <br /> 1988, and should not be subject to the requirements of AB2448.
