0 0 <br /> ENFORCEMENT PROCEDURE <br /> Violation(s) of County and/or State law(s) have been identified on the referenced property. If the <br /> violation(s) are not corrected within the specified time frame, one of the following enforcement <br /> options will be initiated. All enforcement costs incurred by this agency to bring the violation(s) into <br /> compliance are to be paid by the responsible person. Failure to pay these costs will result in a special <br /> assessment added to the property tax. <br /> Agency enforcement costs are accrued from the time the violation(s) are documented until the <br /> abatement has been confirmed. Enforcement costs are in addition to any fines or penalties that may <br /> be assessed through the enforcement options identified below. <br /> ENVIRONMENTAL HEALTH DIVISION ENFORCEMENT OPTIONS <br /> 1. Referral to the District Attorney for prosecution as a misdemeanor. A misdemeanor may <br /> be punishable by a fine of not more than $500 or by imprisonment in the County jail, or by <br /> both fine and imprisonment, unless otherwise specified by the County Ordinance Code. Each <br /> day the violation(s) is found to exist shall be considered a separate offense. <br /> 2. Infraction Citation requiring the responsible person to appear in Municipal Court to enter a <br /> plea. The bail schedule is as follows: <br /> First Offense............$100 fine plus court penalties <br /> Second Offense...........$200 fine plus court penalties <br /> Third Offense............$500 fine plus court penalties <br /> The fourth and subsequent violation will be handled as a misdemeanor through filing a formal <br /> complaint with the District Attorney's Office. However, in the event of a major public health <br /> & safety threat, a misdemeanor complaint may be requested when the first, second, or third <br /> offense is documented. <br /> 3. Administrative Abatement or removal of the violation by the County. The cost of removal <br /> to be paid by the property owner. If the costs are not paid upon demand, a special assessment <br /> will be added to the property tax. <br /> APPEAL PROCEDURE <br /> If you do not agree with the conditions or requirements of this notice, you may request a hearing <br /> before a Hearing Officer appointed by the Director of Environmental Health. This hearing must be <br /> requested in writing within thirty (30) days of verbal or written notice of a violation(s). If the Hearing <br /> Officer finds that there is no basis to substantiate the validity of the appeal, the hearing cost will be <br /> added to the enforcement cost. <br /> wp\naienf.pro 2/95 <br />
