A AGREEMENTFOR,ACCEPTANCE OF MATERIALS Teichert Constructionhereinafter Contractor))�is presently y performing work for The City of Modesto (hereinafter Project Owner). Contractor is excavating for road/infrastructure purposes and has available ew-di/roadway materials consisting of asphalt, dirt and rock and other fill material. The undersigned(hereinafter Property Owner)requests Contractor to place such earth materials upon the undersigned's property. .The,t'roperty (Brie{Description)- 23023 Santa Fe Road- Riverbank, CA 95367- Peter palomino (property Owner) The Property Owner agrees that Contractor may permanently place fill material on The,Property (described above),using trucks or other earth moving equipment,and further agrees that Contractor has the obligation to perform in accordance the Conditions ojAgreement to Dump(below). Contractor agrees to indemriif},the Property Owner for any injury or damages incurred due to the sole negligence of the Contractor strictly during the placement of the fill material. Subject to the foregoing exception,the undersigned expressly releases both Contractor and Owner,including their officers,employees,agents and subcontractors from any claims or demands for damage or injury to person or property arising out of the placing of said fill material on The Property. Unless otherwise stipulated,the undersigned agrees to obtain all required approvals and/or permits and pay any associated.;fees, if necessary. Condition o Areement to Pymp. Teichert Construction shall }caul material to the above mentioned site. Property owner shall be responsible for ingress and egress of trucking as well as support for the dump site. Support will be considered direction of trucks at dump area, traffic control for ingress and egress, and any support necessary to comply with city or state SWPPE regulations.
