You stated that the facility reached <br /> capacity before the first of the year and had not accepted any additional waste since that time. Also, <br /> RMC Pacific Materials had not yet decided if the waste should be mined as recycled material or if the <br /> facility should be closed. Please be aware that Regional Board policies encourage waste recycling <br /> whenever it can be done without threatening water quality, however the Kerlinger Plant landfill cannot <br /> be left open indefinitely. <br /> Reaching capacity and no longer accepting waste is a material change in the volume of the waste <br /> discharge at Kerlinger Plant waste management unit(WMU). Waste Discharge Requirements Order No. <br /> 89-131 C. Provisions: 3. states: The Discharger shall notify the Board in writing of any proposed <br /> change in ownership or responsibility for construction or operation of the WMUs. The Discharger shall <br /> also notify the Board of a material change in the character, location, or volume of the waste discharge <br /> and of any exposed expansions or closure plans. This notification shall be given 90 days prior to the <br /> effective date of the change and shall be accompanied by an amended Report of Waste Discharge and <br /> any technical documents that are needed to demonstrate continued compliance with these WDRs. <br /> RMC Pacific Materials is in violation of the requirement to notify the Board 90 days prior to ceasing <br /> waste discharge. Written notification that the waste management unit is no longer active should be <br /> submitted immediately. A plan to either close the unit or mine the unit for recycling material should be <br /> submitted by 12 September 2005. <br /> The Kerlinger Plant landfill accepted only concrete and asphalt waste and not designated waste. <br /> Therefore,the closure need not comply with all closure requirements mandated by Title 27, California <br /> Code of Regulations.
