MEMORANDUMLEN' <br /> YPl-T (j <br /> j <br /> ' <br /> t l yVl pc/ <br /> 91 ,9'x° 1.4 PM 2' 1 r <br /> August 27, 1992 <br /> TO: Gary Ingraham, Assistant City Manager <br /> FROM: Stephen Chen, Deputy Public Works Director/SWB <br /> SUBJECT: .POSSIBLE CONTAMINATION SITE AT 2441 CHARTER WAY <br /> In response to your memorandum dated August 20, 1992, I have done research on this property <br /> and found that since October 5, 1959, the City has had different agreements and amendments <br /> with a contractor named Solid Waste Disposal Company for the incineration and disposal of city <br /> garbage on the contractor's privately owned property. <br /> Attached are copies of documentation regarding this matter: <br /> Assessor's Map and Property Owner information. <br /> Agreement dated October 5, 1959. <br /> Supplemental Agreement dated February 3, 1961. <br /> Amendment to Supplemental Agreement dated January 29, 1962. <br /> Agreement dated September 18, 1962. <br /> Mr. John GiambIastia.ni told me that Mr. Ray Cesar may have some knowledge regarding this <br /> site. Mr. Doug Wilson remembers that the incineration portion of the agreement never <br /> materialized. For some reason, the City Clerk's office does not have any record of how and <br /> when the 1962 Agreement was terminated. I asked a few of the retired employees about this <br /> matter, but nobody seems to have any knowledge of it, other than confirming that the dump was <br /> there years ago. <br /> It is my understanding that if the site has proven contamination, the generator, (in this case, the <br /> City), will very possibly be dragged into cleanup work as one of the responsible parties. It <br /> appears to me that if there is no reason for the City to believe or to speculate t 2 <br /> contaminated, there is nothing l report. <br /> a <br /> This represents my own point of view.
