MEMORANDUMLEN' YPl-T (j j ' t l yVl pc/ 91 ,9'x° 1.4 PM 2' 1 r August 27, 1992 TO: Gary Ingraham, Assistant City Manager FROM: Stephen Chen, Deputy Public Works Director/SWB SUBJECT: .POSSIBLE CONTAMINATION SITE AT 2441 CHARTER WAY In response to your memorandum dated August 20, 1992, I have done research on this property and found that since October 5, 1959, the City has had different agreements and amendments with a contractor named Solid Waste Disposal Company for the incineration and disposal of city garbage on the contractor's privately owned property. Attached are copies of documentation regarding this matter: Assessor's Map and Property Owner information. Agreement dated October 5, 1959. Supplemental Agreement dated February 3, 1961. Amendment to Supplemental Agreement dated January 29, 1962. Agreement dated September 18, 1962. Mr. John GiambIastia.ni told me that Mr. Ray Cesar may have some knowledge regarding this site. Mr. Doug Wilson remembers that the incineration portion of the agreement never materialized. For some reason, the City Clerk's office does not have any record of how and when the 1962 Agreement was terminated. I asked a few of the retired employees about this matter, but nobody seems to have any knowledge of it, other than confirming that the dump was there years ago. It is my understanding that if the site has proven contamination, the generator, (in this case, the City), will very possibly be dragged into cleanup work as one of the responsible parties. It appears to me that if there is no reason for the City to believe or to speculate t 2 contaminated, there is nothing l report. a This represents my own point of view.
