AMENDMENT TO SUPPLEMENTAL AGREEMENT FOR THE ESTABLISHMENT, OPERATION AND MAINTENANCE OF A GARBAGE AND REFUSE DISPOSAL FACILITY FOR THE CITY OF STOCKTON, CALIFORNIA This Amendment to Supplemental Agreement for the Es- tablishment, Operation and Maintenance of a Garbage and Refuse Disposal Facility for the City of Stockton, California, made and entered into this 29th day of January 1962, by and be- tween SOLID WASTE DISPOSAL COMPANY OF CALIFORNIA, a Corporation organized and existing under and by virtue of the laws of the State of California, hereinafter called "CONTRACTOR", and the CITY OF STOCKTON, a Municipal Corporation organized under the laws of the State of California, hereinafter called "CITY". W I T N E S S E T H: WHEREAS, under the provisions of Resolution No. 22,656, adopted by the City Council on January 30, 1961, City entered into a Supplemental Agreement for the Establishment, Operation and Maintenance of a 04tbage and Refuse Disposal Facility for the City of Stockton, California, dated February 3, 1961, with Con- tractor, and WHEREAS, said Supplemental Agreement set forth a date whereby the construction of said facilities would be com- pleted and providing for a monetary penalty against Contractor for failure to complete construction by said date, and WHEREAS, it is the desire of the parties hereto that the date set for the completion of said Facilities be extended to July 31, 1962 and that the monetary penalty provisions of said Supplemental Agreement be waived to and including July 31, 1962, and be in full force and effect commencing August 1, 1962, and WHEREAS, it is the further desire of the parties hereto that Paragraph 3 of said Supplemental Agreement be amend- ed to clarify the method of computing payment by City to Con- • tr0.-f,^" 4:nv- a-rr-ee*a t^^^nn^ ^4: —A --49..-,.
