r <br /> A <br /> g <br /> ATTACHMENT 3 <br /> SOME DEFINITIONS FROM THE TPCA <br /> Discharge: Discharge means to place, to dispose of, or to store <br /> liquid hazardous wastes or hazardous wastes containing free <br /> liquids into a surface impoundment (Section 25208 .2 (f) . <br /> Cease the Dischaj e: For the purpose of TPCA, discharge to an <br /> impoundment is considered to have ceased (or no person shall be <br /> considered to be discharging) if: <br /> 1. All introduction of hazardous waste into the impoundment <br /> has ceased. <br /> 2 . All liquid wastes and all hazardous waste (including <br /> sediment and sludge) containing free liquid is removed from the <br /> impoundment. <br /> 3 . Any remaining hazardous waste sediment and sludge is <br /> prevented from saturation with liquid. (Note: this condition is <br /> best achieved by removal of all hazardous waste from the <br /> impoundment. ) <br /> 4. Any liquid (including rainfall) is prevented from entering <br /> the pond excavation if underlying soil contains hazardous waste. <br /> Close the Impoundment: In addition to ceasing the discharge (see <br /> above) , "close the impoundment" includes "any operations <br /> necessary to prepare that waste management unit for postclosure <br /> maintenance which are conducted pursuant to the federal Resource <br /> Conservation and Recovery Act of 1976 [RCRA] (42 U.S.C. Sec. 6901 <br /> et seg. ) , and the regulations adopted by the state board and the <br /> department [DHS] concerning the closure of surface impoundments" . <br /> The closure regulations administered by the state board are <br /> contained in Subchapter 15 (commencing with Section 2580) , <br /> Chapter 3 , Title 23 of the California Administrative Code (CAC) . <br /> The closure regulations administered by DHS (Department of Health <br /> Services) are contained in Chapter 30 (commencing with Section <br /> 67210) , Division 4, Title 22 of the CAC. Essentially, these <br /> regulations permit two types of final closure: one, clean closure <br /> [reference Section 67288 (a) of Title 22] and two, closure where <br /> waste remains in subsoil [reference Section 67288 (b) of Title <br /> 22] . <br />
