I <br /> 1 <br /> i <br /> CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> CLEAN-UP AND ABATEMENT ORDER <br /> FOR <br /> ARCADY OIL COMPANY <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, <br /> (hereafter Board) finds that: <br /> 1. The Arcady Oil Company, 712 Fair Oaks Avenue, Suite 211 , South Pasadena, <br /> California 91030, operates a Class III Drilling Mud Disposal Site near the <br /> town of Holt on Cook Road adjacent to Trapper Slough. <br /> 2. The Regional Board adopted waste discharge requirements for this site on <br /> 23 July 1976 in Order No. 76-152. <br /> 3. On, or about, 5 January 1978 the levee which separates Trapper Slough and <br /> the Arcady Oil Company's mud disposal site failed, *causing the site to be <br /> inundated and allowing the site to be "flushed" by tidal action. Investi- <br /> gations by the Board's staff, the Department of Fish and Game, and the <br /> U. S. Coast Guard have revealed that oil and other wastes were discharged <br /> from the disposal site to Trapper Slough and Whiskey Slough, surface <br /> waters of the Sacramento-San Joaquin Delta. <br /> 4. The Arcady Oil Company has effected temporary levee repairs with sand <br /> bags which are inadequate to prevent seepage through the levee or to <br /> protect the site during the highest expected flood tide. <br /> 5. The Arcady Oil Company has violated and threatens additional violations <br /> of its waste discharge requirements Order No. 76-152. <br /> 6. Issuance of this Order is exempt from the provisions of the California <br /> Environmental Quality Act (Public Resources Code Section 2100, et seq. ) , in <br /> accordance with Section 15108, Chapter 3, Title 14, California Adminis- <br /> trative Code. <br /> IT IS HEREBY ORDERED, that pursuant to California Water Code Section 13304, <br /> the Arcady Oil Company shall : <br /> 1. Clean up oil deposited at the drilling mud disposal site and abate further <br /> discharge of wastes to surface waters forthwith. <br /> 2. Cease further discharge of all wastes at the disposal site until written <br /> approval to resume discharges is received from the Executive Officer. <br /> 3. Comply with the following time schedule to assure continuous compliance <br /> with waste discharge requirements Order No. 76-152: <br />
