Broadway St. <br /> Stockton, CA 95205 <br /> Subject: Accumulation of inert debris located at 878 N. Golden Gate Ave., Stockton, CA <br /> A complaint was received by the Environmental Health Department(EHD)that alleges that the above <br /> property is receiving loads of construction debris. The EHD made a site visit on 11/30/2010. There was a <br /> large pile of broken concrete and a small amount of asphalt(Type A Inert) debris located on the property. <br /> Title 14, Section 17383.7(a)states that: <br /> All inert debris�ype A r ces in operations subject to this Article hall comply with the EA Notification <br /> requirements set of th in fT R, 1itie 14, Division 7, Chapter S.0,Article 3.0 and commencing with section 18100. <br /> (a) Iner debris stggred for more than 6 months that has not�ieen processed and sorted for resale or reuse shall <br /> be eemed to have een unlawf 11 disposed, and therefore subject to enforcement action including the use <br /> of a Notice and Order as prove ed in section 18304. <br /> A Notice to Abate was then mailed certified on 12/2/10 and received by Frank Spingolo on 12/3/10. The <br /> letter stated that all of the inert debris being stored at the above location must be processed for reuse, <br /> resale or removed to a proper disposal facility within 6 months from the date the inert debris was received <br /> at the site (site inspection on 11/30/10). A re-inspection of the site was conducted on 5/31/11 (6 months <br /> after date received). The piles of broken concrete and asphalt(Type A Inert) debris were still located on <br /> the property. If the waste is not processed or removed within 30 days of receipt of this notice, further <br /> enforcement may result.
