The EHD made a site visit on 11/29/2010. There was a large pile of broken <br /> concrete and a small amount of asphalt(Type A Inert)debris located on the property. <br /> Title 14, Section 17381 (k)(1)states that: <br /> (1) "Tye A Inert debris"includes but is not limited to concrete(includin fiberglass or steel reinforcing bar embedded in the <br /> concre e) fully cured asphalt, lass,fiberglass, asphalt or fiberglass roo in#shingles, brick,slag ceramics,plaster, clay and <br /> clay products. Type A inert de ris is waste that does not contain soluble po utants at concentrations in excess of water quality <br /> objectives and has not been treated in order to reduce pollutants. The board, upon consultation with the State water Resources <br /> Control Board, will determine on a case by case basis whether materials not listed in this subdivision qualms as Type A inert <br /> debris. <br /> Title 14, Section 17383.7(a)states that: <br /> All inert debrisTyppe A processin operations subject to this Article shall comply with the EA Notification requirements set <br /> forth in CCR, Title 74, Division 7, hapter 5.0,Article 3.0 and commencing with section 18100. <br /> (a) Inert debris stored for more than 6 months that has not been processed and sorted for resale or reuse shall be deemed <br /> to have been unlawfully disposed, and therefore subject to enforcement action including the use of a Notice and Order <br /> as provided in section 18304. <br /> All inert debris being stored at the above location must be processed for reuse or resale or removed to a proper <br /> disposal facility within 6 months from the date received. The EHD will conduct a re-inspection of the site on May <br /> 29,2011.Failure to process or remove the waste may result in further enforcement from this department.
